Q: Good day,
After completing 1.6 yrs work I was terminated from the company (the reason is low performance as per company opinion). I was terminated without any notice period.
I filed a case in Labour Department for non-payment of the end of service gratuity and all benefits. A company representative didn't come to the Labour Department after 48 hrs and is still refusing to pay the full amount.
Then I filed a case in the court, then I was sent from the court to a typing center service. In typing center they typed something and told me to come back after 10 days. In the meantime, I have only 7 days left to exit the country as per my visa cancellation.
How and where will I check for my overstaying in Dubai due to this case I open in the court and typing center told me to come back after 10 days?

Employer's refusal to pay end of service benefits

Q: Good Morning!
I'm writing to you in hopes of any help you can give me. I'm a single mom and sole provider of my family back home. Last Feb 15, 2017 I was terminated. Now, my former employer is blackmailing me for them not to pay me any of my end of service benefits.
I have not received any end of service benefits and they are not being cooperative and they are threatening me with police prosecution. I am begging for any help you can extend. Even legal advice on my situation will be dearly appreciated. Please. I need help. I am appealing to anyone in your office to please help.

س: هل من القانوني أن تحتفظ الشركة بجواز سفر العامل؟
لم أحصل على جواز سفري بعد ختم التأشيرة، أعطوني نسخة من جواز السفر مع صفحة التأشيرة.
أخبرني موظف العلاقات العامة أن جميع جوازات السفر يجب أن تبقى مع الشركة ويمكنني الحصول عليه للسفر بعد موافقة الإدارة فقط.
وأوضح أن هذه هي سياسة الشركة وأن هذا الفعل شائع.

Q: Good day Sir,
Please, I would like to know if it is legal for an employer to hold his employee's educational certificates and passport after frequent requests by the employee to return his documents?
This has cost me a lot of loss in terms of time and money while doing online courses.

لقد رفعت قضية عمالية (عمالي كلي) وتم الحكم لصالحي، ونحن الآن في شهر مهلة الاستئناف. وبعد مرور الشهر وكلا الطرفين لم يستأنفا، يفتح ملف تنفيذ.
السؤال، هل يجوز طلب جواز سفري من الشركة والاحتفاظ به لدي؟

س: مرحبًا،
كان لديّ قضية عمالية وصدر الحكم. ويجب على الشركة دفع مستحقاتي. مشكلتي هي أنني تجاوزت مدة الإقامة المحددة خلال الثلاثة أشهر الماضية.
لقد فتحت بالفعل ملف التنفيذ من أجل الحصول على مستحقاتي من الشركة. طلبت من الشركة إلغاء تأشيرتي. ولكنهم لم يلغوها.
ماذا يجب عليّ أن أفعل في مثل هذه الحالة؟
هل يمكنني إلغاء التأشيرة بنفسي؟
إذا كانت الإجابة بنعم، هل يجب عليّ دفع غرامة تجاوز مدة الإقامة المحددة؟
هل هناك إمكانية لتجنب دفع الغرامة؟

Labor rights of an employee when the employer refuses to hand passport

Q: Hi Sir
I was canceled by my employer but he refused to hand over my passport. He doesn't want me to change my status and I don't know the reason.
He canceled the visa without my knowledge and he sent me the cancellation paper on the 10th day of my grace period for which he knew I only have 28 days.
I asked him to give me my passport because I have to renew it before I can apply for a new visa or change my status, it states that a passport should be more than 6 months before a UAE visa can be issued.
He, later on, put on absconding that I ran away but it's false.
I also lost my wallet phrase which I wrote and hid inside the cover case of my passport and about $37,000 worth of crypto has gone missing because I can't find the trust wallet phrase to recover my crypto.
They want to give me the passport but that cover case is missing, can I file a case for compensation for putting false absconding and unlawful holding of my passport and know the whereabouts of the passport cover case?

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
