Legal action against the husband for abandoning wife and child

Q: I am a resident of Dubai. I want to ask about my husband who brought me from Dubai along with my 3-year-old son by fraud to spend a vacation in Pakistan in Dec 2019. He forcefully took over child passport and other documents of UAE visa and left us alone in Pakistan and runaway back to UAE. I am on an employment visa and my son is under his father`s visa. I need to come back, but my husband is keeping the passport in Dubai with him and he is not ready to give it back to me. I am stuck in Pakistan as I need to bring my son to UAE. Now he threatens that he misplaced all my personal belongings; my gold, jewellery and important documents in my absence from home in Dubai. He wants to divorce me in Pakistan; that`s why he is forcing me to stay in Pakistan so I cannot file a maintenance and child care claim in Dubai. If I come back to Dubai, can I get help to get my son`s passport from him in order to bring him to the UAE because the child can`t live without his mother?

Selling a share in a business without knowing its value

Q: I started a business with a partner (50/50 shares) who is managing the business, supported by my contributions to marketing and operations. After 1 year of business, I`m still not getting clarity concerning the collections and payments, etc. Money is often collected by my partner in cash mode instead of the bank. My partner keeps saying stay away from this and just focus on marketing and operation. Now I have decided to quit this business, but since there is no proper account, I`m not sure how much I should sell my 50% shares for. Kindly advise me on how can I come out of this business and how much I should sell my shares for!

التوقيع على أوراق التسوية دون الحصول على المستحقات

س: مرحبًا! قامت الشركة التي عملت بها لمدة ثلاث سنوات بإنهاء خدماتي عبر إرسال إخطار لمدة شهر. عثرت على عمل آخر خلال هذه المدة، و بعد انتهاء فترة الإخطار، لم تقم الشركة بدفع مكافأة نهاية الخدمة ولا المرتبات المُعلَّقة وطُلب مني التوقيع على ورقة تسوية للبدء بإجراءات نقل الإقامة إلى الشركة الجديدة. وقَّعت مُرغمًا على الورقة بدون الحصول على المستحقات خشية أن أخسر وظيفتي في الشركة الجديدة؛ لأنه لا يمكنني مباشرة العمل دون البدء بإجراءات نقل الإقامة. مضى شهر على مباشرتي للعمل في الشركة الجديدة وإلى الآن لم أحصل على مستحقاتي من الشركة السابقة بحجة عدم توفُّر الأموال. من ناحية أخرى، ما زلت أستخدم سكن الشركة السابقة لعدم قدرتي المادية على الانتقال إلى مسكن مستقل قبل الحصول على مستحقاتي. أولاً: هل يحق للشركة السابقة اقتطاع أجرة المسكن من المستحقات التي ما زالت بحوزتهم عن الفترة التي تلت انتهاء مدة الإخطار؟ فأنا ما زلت إلى الآن أستخدم سكنها للسبب الذي ذكرته سابقًا. ثانيًا: ماذا أفعل للحصول على مستحقاتي؟

Possibility to hold renewing a labour contract for a few months

Q: Hi, I am on my father`s visa. My labour contract in a private company is getting expired in April. I want to apply for 6 months long leave and planning to rejoin by August. Will there be any issue if I leave early without renewing my labour contract which is due in April? Will the expense incurred by the company to renew my labour contract in April (which is not possible since I would be on leave) and the expense to reapply for another labour card when I return from leave in August be the same? Please note that I am not on the company`s visa.

حجب البنك لمستحقات نهاية الخدمة الخاصة بعميل دون إخطاره بسبب ترك وظيفته

س: السلام عليكم، تركت وظيفتي في فبراير 2019 وانضممت إلى شركة جديدة في نفس الشهر. كان لدي، في ذلك الوقت، قرض من بنك لسيارتي بدين مستحق يبلغ حوالي 15000 درهم. أبلغ عملي القديم البنك بأنني تركتهم. وعلى ذلك قرر البنك، دون إخطاري، حجب كامل مبلغ استحقاقات نهاية الخدمة عن وظيفتي القديمة على الرغم من: 1) دفع جميع دفعات القرض عن السنوات الأربع الأخيرة بالكامل وفي الوقت المحدد للدفع. 2) إيداع راتب وظيفتي الجديدة في حسابي مع البنك. بعد التحدُّث مع البنك وتقديم شكوى لديهم، فكوا جزءًا من المبلغ ولكن حجبوا 10000 درهم. وهم ينقصون المبلغ المحجوب شهريًا. واليوم لا يزالون يحتجزون 5000 درهم. لا تنص مستندات القرض التي وقعتها على أن البنك له الحق في حجب أي مبالغ في حالة فقد أو تغيير وظيفتي، ومع ذلك، أبلغني موظفو البنك بأنها "سياسة البنك" (Bank Policy). ورفضوا مشاركة هذه السياسة معي. هل يمكنني الإبلاغ عن البنك لخيانته للأمانة؟ حيث أنني أودعت راتبي وأموالي لدى البنك والبنك اعتدى عليها بدون حق.

س: حُكم عليّ حكم ابتدائي ٦ أشهر في قضية، وفي الاستئناف، صدر حكم بالبراءة. هل البراءة تظهر في الفيش والتشبيه؟ مع العلم أن القضية مضت عليها سنة.

التصرف القانوني حيال إيصال أمانة على بياض

س: وقعت على إيصالي أمانة على بياض لابن عمي على مبلغ ٢٠ ألف جنيه وحررت محضر بالإيصالين، وقدم هو إيصال عليّ بمبلغ ٩٥٠ ألف وقال في المحكمة أنه مسافر ويرسل الأموال لأخيه وهو يوصل المبلغ وأنا معايا إيصال على أخيه على بياض. إذا أنا قدمت الإيصال بالمبلغ الذي أثبته في المحكمة، فهل يمكنه أن يعطي أخيه الإيصال الثاني كي يشكوني به لأنني شكوته وقد حررت محضر أن لديه إيصالين عليّ؟
