هل يُعد تاريخ إصدار براءة الذمة هو نفسه تاريخ الإخلاء الفعلي؟

س: عندما يحكم القاضي بأنه على المستأجر سداد كافة المترتبات الإيجارية حتى "تاريخ الإخلاء الفعلي"، هل يأخذ قسم التنفيذ تاريخ إصدار براءة الذمة على أنه تاريخ الإخلاء؟ مع العلم أن المستأجر قام بإخلاء المنزل قبل براءة الذمة بحوالي أسبوع ولكن المالك لم يكن على علم بذلك. وهل يحق للمالك احتساب أي مبالغ إيجارية بعد تاريخ براءة الذمة؟ أم أنه يتوقف تلقائيًا احتساب مبالغ إيجارية بعد تاريخ براءة الذمة؟ وجزاكم الله خيرًا!

بنك يرفع الفائدة بصورة غير عادية. ماذا أفعل؟

Q: هل يستطيع البنك أن يرفع دعوى ضد عميل على خلفية استهلاك بطاقة ائتمانية بسبب التوقف عن دفع الأقساط لارتفاع ملحوظ في الفوائد؟ علمًا بأنه لا توجد أي اتفاقية أو عقد مبرم بين الطرفين أو مستند أو ما يثبت أن العميل استهلك هذه البطاقة أو أي توضيح بشأن نسبة الفوائد أو أي دفعات إلزامية للبنك. هل ستأخذ المحكمة هذه النقطة بعين الاعتبار؟ البنك يسعى بدوره إلى رفع معدل الربا (الفوائد) بصورة غير عادية أي بنسبة فائدة 40%. هذا أبشع أنواع الاستغلال مع عدم المصداقية في التعامل! أشار البنك في بداية الأمر إلى أن هذه البطاقة الائتمانية هي قرض حسن وليست ذات فائدة. (أين موقعها من الإعراب من القضايا في قانون الإجراءات المدنية الإماراتي؟) الرجاء الإفادة وشكرًا!

Can the property buyer hold payments due to continuous delay in the date of handover?

Q: Can a developer force the last payment (on possession/handover) after a 3-4 years delay? I purchased villas in 2014, fulfilled my obligations and paid 90% each by May 2017(on time). One villa has now been completed (April 2021) and the developer has been on my neck to pay since; no rest, nonstop calls, emails, penalties, and even threats of termination. They STILL haven`t completed the other villas. I sent a letter for an extension for 6 months and it was denied. Please advise on what to do. Thank you!

Q: Hi Sir/Madam. I was renting an apartment in Sharjah. My agreement has finished and I got a NOC from the landlord to cancel my flat. I canceled my municipality, SEWA and everything, and later my landlord filed a case against me in RDC. I showed all the cancellation papers to the judge and he said to show him the payment receipt, but I forgot to take it from the landlord. Now I don`t know how to deal with this.

The employer is not providing release papers on the expiry of limited contract

Q: Sir, I am M. S. holding a limited contract - engineer visa, and working in a private company. My labor contract will expire on September 24. I got a better opportunity with twice of salary which I am getting previously. I sent the non-renewal letter on 19 August 2021, with 30 days notice period. I need to join the new company on or before Sept 19. The new company can hold the offer maximum till September 2021. My company is not willing to give the release within 30 days. Q: Hello, I had recently signed a sale contract of my property through a broker in Dubai. The broker was supposed to have the deposit 10% cheques. When I had asked for a copy of the deposit cheques, I realized it was from a third party. Doing a background check of the third party company, I discovered that the third-party company had an expired trade license (they provided valid dates on trade license, meaning government trade license document was forged) and now the sales agreement dates are coming to an end; I don`t have managers cheques nor valid deposit cheques. The only documents I have are deposit cheques from a third party, letter of assurance from the third party company (with forged copy-pasted signature and no stamp, forged trade license of the third-party company). What can I do?

Refund of the amount paid to an immigration agency for breaching the agreement terms

Q: We have signed an agreement in October 2020 as a “UK Start-Up visa” with immigration advisers in the UAE. According to the agreement, we have paid AED 25000/- as a full package to get the visa. After submitting the application and following up for the last 6 or 7 months, they are now disclosing and asking for endorsement fees of 50,000/- GDP, which need to pay endorsement bodies for 2 years. Earlier, they did not inform us nor mentioned it in any article of this agreement, which shows it was hidden from us at the time of signing the agreement. Seeking compensation because of an accident in a hotel

Q: I had an accident in a hotel in Dubai. When I tried to go out, my face got hit by the glass door. My nose got hurt with bleeding and cut over it. I don`t know if I can do something against the hotel since there was nothing on the glass; like a sticker that tells it is locked. It is very dangerous!
