س: السلام عليكم، تواصل معي شخص على الهاتف وطلب مني خدمة إنسانية. يريد مني إرسال نقود إلى سوريا بحكم إقامتي بين دبي وسوريا على أن يودع المبلغ في حسابي في الإمارات. وبالفعل أودع المبلغ في حسابي وقمت بتسليم الأمانة. يوجد بيني وبين هذا الشخص محادثات على الواتساب تفيد بأنه أودع المبلغ في حسابي، ولكن لا يوجد إثبات أنني قمت بتسليم الأمانة. هل يمكن له أن يشتكيني ويدّعي أنني لم أسلِّم الأمانة؟

استرداد مبلغ أخذته سيدة للشراكة ثم ادعت الخسارة

س: السلام عليكم ورحمة الله وبركاته، اتفقت مع سيدة على الشراكة في محل تجاري. حولت لها المبلغ تحويلاً بنكيًا وبعدها لم أسجِّل اسمي بصفة شريكة. كانت تتهرب وبعد شهرين من التحويل، أرسلت لي رسالة أن خذي أغراضك من المحل فقد خسرنا وسلمت أختي المحل وليس لك شيء عندي (علمًا بأن المحل موجود وهذا الكلام منذ عام ٢٠١٩). طالبتها بإرجاع المبلغ وقالت ليس لك شيء عندي وبعدها حظرت رقمي. حاولت أحل الموضوع معها بدون محاكم ولكنها لم تستجب لي. توجهت للمحكمة ورفعت قضية والمحامي طالب باسترداد الدين الذي في ذمتها بدون شرح تفاصيل الموضوع. جاء ردها بأنها تنكر المبلغ وبعدها أقرّت أن التحويل كان بهدف الشراكة في محل وليس قرض. طلبت المدَّعَى عليها بتوجيه اليمين الحاسمة أن المبلغ قرض وليس لهدف الشراكة. أنا لم أحصل على الشراكة ولم يتم استرداد المبلغ. ما الحل؟ جزاكم الله كل خير!

Q: I am working for a company in Dubai since 2009. I am on an unlimited contract and planning to resign by the end of next month. The company is going thru financial issues for 6 years and the employee benefits are not settled for all employees who resigned in the last few years. Q: Hi, I am working with an employer in Dubai since October 1st, 2021. The company is deducting salary in the name of consultancy as I was got hired from India. But there was no such contract between employee&employer for deduction in salaries. Still, the employer deducted my half the salary for 2 months and I requested to stay at room till the company gets new project also they have taken my educational certificate stating it is the company policy. I have already emailed the company to pay me a full salary for staying in the room or give me NOC. 1. Can I resign from the company without a notice period as I am in probation period and my contract is limited? 2. What should I do if the company doesn`t pay me my salary for the days I am staying in the room? 3. Can this be considered a breach of contract by the employer?
