جاء المرسوم بقانون اتحادي رقم 15 لسنة 2021 بطريق طعن غير عادي وجديد كلياً هو الرجوع عن الأحكام الباتة، حيث وضع المقنن الإماراتي طريقاً استثنائياً في المادة الجديدة كلياً (187 مكرراً) من قانون الإجراءات المدنية الاتحادي، أباح فيها طلب الرجوع عن الأحكام الباتة لثلاثة حالات محددة على سبيل الحصر وبإجراءات محددة تفصيلاً. في هذا المقال تجدون شرحاً تفصيلياً لإجرءات تقديم طلب الرجوع وشروطه، مع تفسير نص المادة 187 مكرر من قانون الإجراءات المدنية بشكل ميسر ومبسط. Can the bank still hold the EOSB even after providing documents of the new job?
Q: I have been regularly paying my monthly installments until I lost my job and I know that the bank will deduct the amount from my EOSB until I get a new job. When I got my new job and processed all the documents like my visa and EID, I immediately submitted them to the bank along with my salary certificate which shows that I have the same salary from my previous employment and the same amount was used as the basis when the bank approved my loan. So basically, I will be able to pay the same EMI. I have been going to the bank several times to check the status of my request for the release of the EOSB and each time I go, they have different statements. Finally, I got a call and the bank says they won`t release it as it has to be partially used as a payment for my loan. What can I do? Questions & Answers

Transferring the employees to a new company without paying the gratuity
Q: Hi, My company in DMCC is planning to shut down. They are not willing to pay us the gratuity. They have offered the remaining staff, including me, to be transferred to a new company they are opening soon. Q: Hello Rajasree 1. The Lease Agreement for apartment rent states to be paid in 8 cheques. no mention of PDC or to give cheques in advance. 2. Lease does not specify that the cheques have to be given in advance or that they are to be PDC`s. 3. I am up-to-date on my rent payments. 4. As the lease did not specify cheques to be given in advance, I give them on a timely basis as and when due. 5. The landlord is demanding that I give the balance cheques as PDC`s and claiming it is a breach of contract. 6. The landlord is giving a 3-day notice to comply with the PDC`s or else pay the full balance of the rent. 7. The landlord is refusing to give me the landlord`s counter-signed lease copy. 8. Can a cheque issuer appeal a performance order judgment?
Q: After a Performance Order judgment is issued for a cheque return case, there is an appeal period of 15 working days I believe. Can the cheque issuer appeal on the grounds that he never received the amount in cash, but it was rather a guarantee cheque for trading for which he was a guarantor and the money was lost in the market?
