س: السلام عليكم، يوجد في عقدي الحالي بند عدم المنافسة لسنتين بالنص التالي: "يلتزم الطرف الثاني (الموظف، أنا) بألا يقوم بعد انتهاء العقد بمنافسة الطرف الأول (الشركة) لمدة سنتين وذلك في أي مكان من الأماكن التي تعمل فيها الشركة فيما يتعلق بعمله". جائني من فترة عرض مغري جدًا بضعف راتبي لدى شركة منافسة وبمنصب إداري علمًا بأنني ما زلت مع الشركة القديمة ولست بمنصب إداري "خبير تسويق". مع العلم أن عرض الشركة المنافسة بمنصب إداري "Director" في التسويق ويتضمن زيادة 50% عن راتبي. أرجو الإفادة بقانونية الانتقال إلى الشركة الأخرى، وهل يحق لهم مقاضاتي في حال أخبرتهم بالذهاب للشركة المنافسة؟ وهل توجد ثغرات تسمح لي بالانتقال تحت مُسمى وظيفي آخر؛ مثلاً " loophole " أو "Workaround"؟ Questions & Answers
