Q: Hi, I have recently resigned from my job. Two days before my last day, my company made an NDA that says that I cannot join the same field of work or join any competitor for the next five years. I have worked 8 years+ in that field. Note: NDA was not there when I joined the company. They just made it prior to my leave. So in this situation, can I start my own business?

The real estate agent is asking for a 26% increase. What to do?

Q: Dear sir/madam, The real estate agent representing the landlord sent me an email 88 days before the end of the contract asking for a 26% increase (from 56k to 70k). I refused and then they offered me 61k and I refused again. Now (55 days before the end of the contract), they have sent me a valuation certificate that states 70k as they wanted. They said that the 61k offer is gone now as they paid to get the valuation certificate. Should I go to RDC or accept this increase?

How many times can the company appeal a labor court judgment?

Q: I am an employee of a mainland company in Dubai. I won a partial labor case of AED 145,000 then the company submitted an appeal and got rejected by the court. I got the final judgment and filed labor execution. The court sent a notice of 15 days which has passed and my company filed a petition to review the labor for my main case, and in the last hearing, the court asked me to reply which I will submit. My question is: how many times can the company appeal like this? And what are the chances this petition court will reject as well and follow the last 2 judgments issued by the court?

What is the grace period after the expiry of a three-month visit visa?

Q: I`m in UAE with a visit visa for 3 months. The visit visa will soon expire. I want to know if there`s any grace period after the Visa expiry. In some places, it`s mentioned 10 days grace period will be there. I just want to make sure as the rules were changed before few days.

Can an employer revoke what is offered in the termination letter?

Q: Dear sir/madam, My employer mentioned what they owe me in my termination. Later, after they fired me and I filed a court case, they sent me another letter telling me if I don’t sign the visa cancellation letter by 2 pm, the amount (which was already mentioned in my termination letter as part of our contractual agreement) will not be paid to me. This is a small local company and I understand that “without prejudice” is not recognized by the UAE labor law. I, therefore, wonder why they labeled it as such. Signing the visa cancellation document mean I had to (falsely) confirm that I received all my dues and that I would waive all my legal rights in bringing a claim. Therefore, I didn’t sign. Question 1: Are they allowed to revoke what they already offered in the termination letter, after they fired me? Question 2: Is it legal to make the payment of one’s dues subject to signing the visa cancellation? (Can you think why they made it “without prejudice”?)
