Issue with rental cheques paid up front

Q: Sir, I have released 7 post dated cheques for house renting on January 12. January 15 is the date of the 1st cheque which is valued 9k. But on January 15, my bank froze my account because my company terminated me. So I told them to not withdraw the cheque coz I got no money in it and I`m cancelling that property. When I asked them I need to collect my cheque, they told me I cannot. Not unless I pay them 9000. Do they have the right to do this? I am in a deep problem as they filed a case against me regarding this. So, I want to know. Thank you.

Can an employee be charged for resignation during probation period?

Q: Hi, I joined a company in Dubai free zone 3 months ago with unlimited contract and a probation period of 6 months. My current situation is that I am not comfortable with my current employer and want to come back to my home country. I have handled my resignation letter 10 days ago. My visa is still in the process of making and I have not got my passport back yet. The company does not want me to leave and now requires me to pay 30000 AED without giving any explanation. Could you please let me know if Free Zone Labor Law allows a company to charge employee resigning from work during probation period? What is the process of resignation from here? When should company return my passport? Regards, Karolis Griskevicius

Divorce and settlement for Muslim expats in the UAE

Q: I`m Tunisian woman married to a British passport holder and we`re both Muslims married in Qatar and live now in UAE. I want to know what happens if I ask for divorce. We grew apart and he`s been nasty with me, threatening me to have a mistress or get married again or even threaten to hit me if I reply to him during an argument. We have a joint account with full ownership (anyone of us has full authority over the account) for both of us but I actually own 90% of the money in it. Lately, after our relationship started suffering, I discovered he transferred all the money to an off-shore account and he didn`t consult me or ask for my permission, until he didn`t tell me about it. I don`t trust him anymore and want to divorce and have my money. Would filing for divorce affect me or my assets (I have another separate current account)? Would I be able to get my money back? How will Sharia law affect this process assuming he won`t cooperate? Please advise.

Penalty for the extension of a tenancy contract

Q: Dear Sir/ Mam, I am staying in Sharjah. We stayed in the same flat for the last 2 years. Our contract is ended on May 5th. But as we are migrating to another country we requested our landlord to stay here till June end 2 months back. He agreed to the same at that time. Now he is asking to give 3 months more rent from June as a penalty to settle the things. Our contract already finished now. Please advice what to do as we are not in a good financial position to give 3-month rent without staying.

Copyright agreement

Q: Hello, I would like some help regarding stating the copyright. I am sending professional photographs that I took to another company for a shared project. I would like to specify to this company that I don`t want them to share my photos with other companies because they are my own work. How do I do that and make it both legally binding and not "rude", as I plan to continue working with this company? I am basically just wanting help with drafting a professional legal email. Thank you for your help. Best wishes, Naj

Q: 1) Since the company is a semi-government entity based in Abu Dhabi, can I challenge the unfair spot termination decision and get 3 months salary (per month salary was AED 7000) and other benefits? 2) Can I claim all my living costs (house rent, bills, car rental, food, telephone, travel/ fuel etc) after notice period finished date i.e. 26 April 2017 as per termination letter (21 days till 17 May 2017 and could end up more weeks)? 3) The termination letter was handed over on 29 March 2017 and last working day was same day but as per termination letter my last working day would be considered as 26 April (that is a difference of 3 days unpaid?) 4) As per my clear instructions to my team to report all necessary matters but in this case, everyone failed to report me and even many Rental Agents kept on renting this vehicle with a low tire pressure sign on the dashboard. 5) Shall I approach the labour court in Abu Dhabi or civil court considering my visa from immigration?

Is it a crime to put wrong information in a salary certificate?

Q: My whole salary including allowances in my contract is 4800 AED, my employer provided me with a salary certificate that states that my salary is 6000 AED. Is that fraud? And if so, to whom should I report this? And what is going to happen to the employer? Note, I have used this salary certificate to get a credit card but I have never used it, and I cancelled it.
