س: السلام عليكم، عملت لدى شركة في القطاع الخاص لمدة ست سنوات وتم التعدي عليّ بالضرب من قبل عامل آخر مستخدمًا خشبة عريضة على ذراعي الأيمن نتج عنها كسر في عظمة الزند وتم تثبيت الكسر بواسطة 5 مسامير وشريحة معدنية. حصلت على تقرير طبي بـ٤٥ يوم من مستشفى حكومي وحرر محضر بالواقعة مرفق به أصل التقرير الطبي وسجل أمين الشرطة المحضر إلى حالة جنح. رفعت قضية وحكم فيها بالسجن لمدة عام وغرامة ١٠٠٠جنيه، وعندما تعافيت قررت أن أعود إلى العمل وبالفعل رجعت إلى عملي، ولكن بعد مرور شهرين فوجئت بأنه تم تهديد صاحب العمل من قبل الجاني لكونه شخص من العرب وقام صاحب العمل بفصلي من العمل لحين التنازل عن المحضر. ما الإجراء الذي يجب اتخاذه ضد صاحب العمل؟

Application of the eviction notice served to the tenant before the contract renewal

Q: Hello, I served my tenant an eviction notice on 5 Dec 2021 to leave the property. His tenancy contract was to be renewed on 5 Jan 2022 and I renewed it for the period of 5 Jan 2022 to 6 December 2022. So is it fine as I am giving him 12 months to evict the property (notice on 5 December 2021)? Or do I need to make it 5 January 2021 to 5 January 2022?

My lawyer is not dealing with my bounced cheque case. what can I do?

Q: Hi all, I recently engaged a law firm in the UAE to help clear some cases against being due to bounced cheques. The firm did not provide any formal quote or letter of engagement and the service, including cost, was discussed via emails. The firm`s response to a request for a quote or letter of engagement was that their internal policy is such that does not provide such correspondence. I was asked to pay the full fees upfront which I did. Prior to and since the engagement began, I have been liaising with a business development person at this firm and I have requested multiple times to speak to the lawyer assigned to my cases. The response I get is a short single-line answer dismissing the request. I have also been asking for an update in terms of progress so far and received responses to the effect "lawyers are working on it". There is no specific update provided in terms of actions, submissions to authorities, or any other matter. Does this approach appear reasonable by a law firm in the UAE?

س: السلام عليكم ورحمة الله، أعمل في فندق بأبو ظبي، وبسبب مشاكل صغيرة تلقيت من المدير ورقة الفصل من العمل. لم أوقع وفي اليوم التالي عندما كنت في الدوام، أحضر لي المدير بعض أفراده ممن يشتغلون في الشرطة لكي أخاف وأوقع على الورقة ولم أوقع لمدة ٣ أيام متتابعة يحضرون لي الشرطة ولا أوقع. بعد ذلك طلب المدير من حراس الأمن منعي من دخول الفندق. لم أستلم رواتب ولا أي شيء منذ شهر ١٢، كنت أذهب إلى الشغل ويجبروني على الرجوع ويطردونني ويقولون لي سوف نلغي إقامتك حين يفتح الطيران إلى بلدك. بعد ٣ أشهر أو أكثر من العذاب مرضت فيها، تفاجأت أنهم ألغوا بطاقة العمل من طرف الشركة ووقَّع المدير في مكاني ولم أستلم رواتبي. مع العلم أنني كنت أذهب يوميا إلى الفندق وهم يطردونني وكنت أدخل أوقّع مقابل بعض الكاميرات. عندما عرفت أنهم ألغوا بطاقة العمل، ذهبت إلى المدير ولم أخبره أنني أعرف كل شيء. تحايلت عليه وإذا به يعطيني أوراق الإلغاء لكي أمضيها. جميع الأوراق مستندات إلغاء حقيقية وتحمل توقيعه بتاريخ هذا الشهر. أخذت الملف ورحلت وهو معي. ماذا أفعل في هذه الحالة لآخذ حقي؟

س: السلام عليكم، اتفق طرفا التعاقد في عقدٍ ما على أن تكون محاكم دبي - على سبيل المثال - هي صاحبة الاختصاص القانوني للنظر في أي نزاع قد يحدث. إذا كان المدَّعى عليه مقيم في إمارة أخرى غير دبي وتم توقيع العقد في إمارة أخرى أيضًا غير دبي، فهل سترفض محاكم دبي الدعوى لعدم اختصاصها أم أنها ستقبلها باعتبار اتفاق الطرفين في العقد على أن تكون محاكم دبي هي صاحبة الاختصاص القانوني للنظر في أي نزاع قد يحدث؟

How to get money back from a fraudulent immigration company?

Q: Dear Lawyer, I worked in Dubai as a materials coordinator in the Jebel Ali Freezone in an oil company for four years. During my work period, I applied for a Polish work permit through an immigration consultant situated in Deira Dubai. I paid my hard-earned money, DHS 3500, for them on April 2021. T., working with a private company in the Emirate of Abu Dhabi since Sep `20. I am having a limited contract for two years which is going to end on Sep. `22. Now, I want to switch the company and am planning to resign from this company in the month of April ’22 (4-5 Months before contract completion) and I will serve 1 month`s notice period as per the contract.
