التعويض عن الضرر الناتج عن إزالة الأدوار العلوية

س: السلام عليكم، بعد التحية، أقيم في شقة بالدور الثامن علوي وفوقها 3 أدوار مكونة من أعمدة خرسانية وأسقف فقط وتم إزالتها من قبل الجهة الإدارية المسؤولة مما أدى إلى شروخ في أعمدة الشقة والأسقف والجدران وأيضًا أصبحت بالدور الأخير من العقار بعدما كنت في الدور الثامن ويعلوه أكثر من طابق. أريد أن أسال بخصوص حقي في المطالبة بالتعويض أولاً لما تسببت به الإزالة من إلحاق الضرر بالشقة وثانيًا لما تسببت به الإزالة والوضع الحالي من انخفاض قيمة الوحدة بالسوق على اعتبار أن الدور الأخير صار أقل بنسبة 30% من قيمة الوحدات السكنية الأخرى. أرجو الإفادة. مع جزيل الشكر والامتنان!

Q: Good morning, I am writing to inquire regarding the non-compete clause. I just resigned from my previous company. I worked as admin staff and I did not have any supervisory roles, nor handle any financial responsibilities. I work for a mainland company in Dubai. Recently, I received a job offer from a competitor to do the same role. The competitor is DMCC and I will be under a Freezone visa. My employment entry permit has already been issued and I am just waiting for my residence visa to be printed. My previous employer threatened me that they will sue me because I signed a non-compete clause with them that should be effective for two years after I resigned. I am wondering if the non-compete restriction will apply to me given that I will be joining a Freezone company this time? I held a non-supervisory/admin level position in my previous company.

رفع دعوى لدى محاكم الدولة رغم وجود شرط تحكيم دولي

س: عقد فيه تحكيم دولي ومقاول الباطن أتمّ الأعمال وتم تسليم المشروع ولكن المشروع كان فيه تأخير ومقاول الباطن وصل مرحلة الإفلاس ولا يستطيع الذهاب إلى التحكيم الدولي. رفع قضية إثبات حق وبالفعل تم تعين خبير هندسي وحسابي وبعد الانتهاء من الاجتماعات مع كلا الطرفين وإيداع كل منهم الأوراق الثبوتية، أظهر التقرير أن مقاول الباطن له حق فوق 22 مليون درهم. المقاول الرئيسي دفع في أول جلسة بشرط التحكيم. مقاول الباطن في حالة إفلاس وهو الآن مُعرّض للسجن بسبب القضايا المتراكمة عليه من البنوك والموردين. هل يُسجَن ويضيع حقه بسبب شرط التحكيم؟ وهل هناك حل بإنهاء القضية عن طريق محاكم الدولة كونه وصل مرحلة الإفلاس وبالفعل رفع قضية إفلاس ولكن تم رفضها لكون رخصته التجارية منتهية وعليها حجوزات؟ ما الحل في هذه الحالة؟ أرجو من أهل الخبرة الإفادة! شكرًا لتعاونكم!

Q: A Jafza employee is on probation and has not completed his notice period. He is asked to leave without completion of the probation period. The offer letter specifies that either party may leave on a single-day notice. To support the employee as per Jafza rules, will the employee qualify for any notice period pay + claim on leave credit? What to do if the employer counts overtime as regular hours?

Q: Hi In Oman, under Oman Labor Law, my contract has the basic salary of 45 hours which is fine and in line with labor law, but there is a second line which states "Additional Hours". We work a 60 hour week so that second line "Additional Hours" is basically 15 hours. The issue is the hourly rate for the 45 hours is the same as the 15 hours no change or an added minimum of 25% to the overtime hours as stated in Articles 68 & 70 in the Oman Labor Law. I have requested the company to backdate and correct this but they are ignoring me, do I have a claim or are they correct with a fixed hourly rate for a 60-hour minimum working week?
