س: السلام عليكم، لدي تعامل تجاري مع شركة الشكل القانوني لها شركة توصية ولدي منها شيكات. الشركة حاليًا مغلقة ورخصتها منتهية ولكن الشريك المخوَّل والموقِّع على الشيكات لا يزال موجودًا ولديه أعمال غير مرتبطة بالشركة. هل يمكن مطالبته بشكل شخصي أم أن المطالبة خاصة بالشركة كون الشيكات صادرة من شركة التوصية والتي كان شريكًا بها؟

الحصول على إفادة البنك بتحويل الأموال لصالح تنفيذ حكم عمالي

س: السلام عليكم، عندي قضية تنفيذ عمالي وتابعت إجراءات التنفيذ إلى الآن. منذ أسبوعين طلبت المنفَّذ ضدها من المحكمة مخاطبة بنك رأس الخيمة الوطني لتحويل المبالغ المحجوز عليها في الحساب لصالح الملف وذلك لتتمكن المنفَّذ ضدها من وقف الإجراءات وإغلاق الملف. صرحت المحكمة بالتحويل ولكنها أشارت إلى عدم وجود وارد من البنك المذكور في الطلب. بعد المتابعة مع البنك المذكور، أشار إلى أنه تواصل مع المحكمة منذ مدة ولكن المحكمة تنفي هذا الأمر وأنا عالق في تلك الدوامة. ما الصحيح من الإجراءات التي يمكنني اتخاذها لإنهاء الموضوع وتحصيل أموالي؟ وشكرًا!

هل يدفع المدين المبلغ الأصلي فقط لدى التخلف عن السداد؟

س: السلام عليكم، أخذت قرضًا بقيمة 25000 وكرديت كارد بقيمة 5000 من شركة تمويل وقد حررت شيكًا بدون تاريخ وبدون تحديد المبلغ وكتبوا في الشيك مبلغ 100.000 بعدما تعثرت في السداد لمدة 6 أشهر. أودعوا الشيك وأخذت رفض وحاليًا البنك عمل تنفيذ وتم الحجز على حسابي البنكي بالكامل. ما موقفي في القضية؟ وهل يمكن أن أُجبَر على دفع هذا المبلغ بالكامل أم المبلغ الذي أخذته فقط؟ مع العلم أنا سددت حوالي 7000 من قيمة المبلغ ولدي النية بالتسوية والبنك لم يتواصل معي منذ أكثر من سنتين والرقم المسجَّل لديهم مُلغى.

How can I get refund for a canceled project and delay in handover?

Q: Good evening, I invested 90% in a property in 2006. The initial developer was jailed, and then it was sold on to another developer. When I lived in Dubai, I went to the Land Department many times but got nowhere. The new developer was given a deadline to start, and that kept changing. I am now in the UK and have emailed the land department many times, but they don`t reply. Finally, they replied to me on Twitter on 21 December 2021. Their words were: `We would like to inform you that the project is under transfer to the Cancelled Projects Committee. It is currently under study. Time took: about two months` I`m not sure if `time took` is just a language error, and they mean that it will take two months. And I don`t know what will take two months, to transfer, to cancel or to get a refund? Obviously, the main thing I want to know is how to get my money refunded as it has been 16 years!!!!! But I`d like to know what the process is. I still have the original contract. Thank you

صدور حكم لصالح البنك بدون علم المدين

س: السلام عليكم، أنا إماراتي الجنسية. مشكلتي أن البنك رفع دعوى في المحكمة لعدم قدرتي على سداد قرض بسبب الفصل من العمل في سنه 2014، ولم أستطع التواصل لأنني كنت في السجن لأمر آخر. عند خروجي في عام 2020، علمت أن القضية حُكِم فيها بإلزامي بدفع مبلغ 600 ألف + 10 آلاف تعويض للبنك وتوقيع حظر على جواز سفري، ولم أتمكن من تجديد الجواز لأن البنك قام بالتعميم وعمل بلوك على جوازي. ما الحل؟ أنا لا أعمل حاليًا ولم أستطيع الحصول على عمل بسبب انتهاء الجواز. كيف أقدم طلب لتجديد الجواز والعفو لسد المديونية؟

Q: Dear sir/madam, I was misled by information from the credit card company, due to which they overcharged me and was unlawfully demanding the amount to be cleared even though the mistake was from their side.
