Procedures to obtain a legal heir certificate

My wife passed away in December. Her end of service benefits was deposited by her company to her bank account.

Now, the bank is telling me to get a court order before they can issue the funds to me. What are the requirements for getting a court order?

Dear Questioner,

I am sorry for your loss. May the soul rest in peace.

I assume that the deceased has not registered a WILL in any of the registries in UAE. In the absence of WILL, the family will have to open an Inheritance case at the Personal Status Court in Dubai.

Upon submission of valid PoA [PoA from all immediate family members], passport copies of the deceased and of the family [along with visa page of the deceased] and a death certificate (has to be attested and legalised), the court will issue a Legal Heir Certificate.

I recommend you to hire a lawyer at this stage. During the hearing stage, you will also have to present two male witnesses to promise before the court with regard to the relationship of the deceased with the applicants of Legal Heir Certificate.
