Filing a case against the developer for cancellation of project

I bought a property in a project and paid the full amount to the developer directly, not in the escrow account.

The property was not complete as promised and it was cancelled by the Land Dept last year.

We reached the Land Dept to make a complaint then we came to know it's not registered under my name.

Please help me to process it and get my money back. I made a complaint in Dubai Courts too but no update.

Dear Questioner,

When you made the payment to the developer, there was a contract signed between you and the developer? Do you still have the proof of payment?

If you have solid documents proving that the property has been sold to yourself and you paid the full amount of the property, then we can open a case against the developer.

Will be useful if we can see all the documents signed between both parties and the proof of payments.

Did you receive last year any notice of cancellation from the land department?

If not, then there would be a big chance to claim your money back.

Dear Questioner,

Regarding your question, you have the right to file a case to terminate the contract between you and the developer because they passed the handover date.

So you have the option to file your case and refund your money with an interest of 9%.
