Here are some of the typical sections you may choose to include in your own influencer contract:
1. Timelines: How long are you intending for this influencer relationship to remain in force? Is this a contract for a one-off campaign, or do you intend there to be a long-term relationship between the influencer and the advertising brand?
2. Deliverables: What precisely is the influencer expected to do as part of this contract? Are there any penalties for late posting? If the expectations are in any way complex, or if this is likely to be a longer-term contract, you might want to add a separate Schedule of Services.
3. Cancellation clauses based on non-performance, poor performance...etc. What are the specific requirements for terminating the contract by either party?
4. A list of things you want to avoid the influencer referring to in his/her posts/statuses. These could include things like mentioning competitors by name.
5. Any approval process that the advertising firm expects the influencer to follow.
6. Confidentiality and Exclusivity.
7. Compensation: an agreed flat rate? performance-based? bonus incentives?
8. Payment Terms.
