Questions & Answers
What can I do if the real estate management is not fixing the issue of blocking noise in my apartment?
Hi,
I rented an apartment 4 months ago, it is managed by a real estate company.
I am going through a technical issue in the unit; the balcony door does not block the noise, and I live near a couple of construction yards.
The property manager sent his team several times to fix the issue, and it only got worse (they replaced the original brushes with weaker ones).
The balcony is attached to the bedroom, and I cannot use the bedroom for sleeping due to outside construction noise, especially during the night. Even earplugs do not help with the strength of the noise.
The property manager is currently ignoring my requests to fix, saying that they cannot get a refund for the wrong fix, and according to them landlord does not agree to pay for another brush replacement.
We have had an email exchange with the property manager for this issue for 3 months already.
I don't want to go through the DLD route, which is expensive (3K AED to register a case) and probably slow too.
What are my options?
Thank you very much!
Hello,
Thank you for reaching out.
Based on your description, the ongoing issue may amount to a breach of the landlord’s obligation to provide a livable property.
If the bedroom is unusable due to external noise and failed repairs, you may have legal grounds to claim a rent reduction, early termination, or compensation, depending on the lease terms and the extent of the defect.
Since the real estate company and landlord are refusing further action, you may still have options to pursue your rights without immediately filing a full case with the DLD.
We recommend booking a consultation so we can review your documents and guide you on the most cost-effective legal route—or, if you prefer, you may authorize our office to act on your behalf.
Best regards,
Dear Sir,
First, you should call the police to report the noise, then file a lawsuit in the Rental Court to terminate the contract and recover the rent, checks, and compensation for the psychological and material harm caused by the landlord.
Dear Questioner,
Thank you for reaching out and sharing the details of your situation.
We understand the inconvenience and distress caused by the ongoing noise issue in your apartment, particularly when it affects your ability to rest and use the property as intended.
Based on your description and the documented communication with the property manager, it appears that the landlord and their representatives may not be fulfilling their maintenance obligations under the tenancy contract and UAE tenancy law.
While taking the case through the Dubai Land Department (DLD) Rental Dispute Center is one formal route, we acknowledge your concern regarding the associated costs and potential delays. However, there are other possible options we can explore:
Legal Notice & Negotiation:
We can issue an official legal notice to the property manager and landlord, demanding proper rectification within a specified timeframe.
This often prompts a more serious response and can lead to a resolution without court involvement.
Contractual and Legal Review:
We can review your tenancy contract and supporting documentation to identify a breach of obligation.
If they have failed to maintain the unit to livable standards, you may be eligible to demand a rent reduction or early termination without penalty.
Alternative Dispute Resolution (ADR):
In some cases, we may be able to mediate the dispute through formal written correspondence or meetings, potentially avoiding the full DLD route and its fees.
Preparing for Escalation, if Needed:
If these steps do not lead to a satisfactory resolution, we can guide you through the Rental Dispute Center process, including the possibility of requesting a waiver or adjustment of the standard registration fee depending on the complexity case details.
We are prepared to assist you with any of the above steps based on your preferred course of action.
Please let us know if you would like to proceed, and we will provide you with a consultation and outline the next steps accordingly.
Kind regards,
Mohammad Salah
