حجز التسوية النهائية دون سبب مشروع بعد الاستقالة

سيدى العزيز،

لقد استقلت من شركتي في سبتمبر 2018 ووافقت على العمل فترة إخطار مدتها شهر واحد. انضممت إليهم في 17 أغسطس وخدمت حوالي سنة وشهرين.

كان ينبغي دفع مستحقاتي في أكتوبر 2018. ومع هذا، لم يعطوني التسوية النهائية حتى الآن. علاوة على ذلك، إنهم يطنعون نزاعًا حول تسويتي النهائية الكاملة.

إنهم يحاولون تهديدي بالمادة 116 التي تنص على خصم 45 يومًا من الراتب. ما زلت على تأشيرتهم (تأشيرة محدودة لمنطقة حرة) وأمضيت الأربعة أشهر الماضية بدون راتب في الإمارات.

لقد أتعبني هذا الوضع حقًا. أنا سئمت منه الآن وأريد تصعيده إلى مستوى أعلى. أريد مساعدة قانونية أريد أن أقاضيهم إن كان بإمكاني هذا.

Dear Sir/ Madam,

Thank you for getting in touch with me on this.

You have not mentioned whether your contract was limited or unlimited? However, I assume it was limited considering the company has quoted Article 116 of UAE Labour Law.

Please note that under Article 116, if you terminate the contract before the expiry period, then you are liable to pay a penalty of the basic salary of 45 days' salary.

They are not authorised to withhold your final settlement on this basis, and even if they wish to, then they can deduct the dues and hand over the remaining dues.

If the company fails to make the payment, then you can raise a labour dispute with the Ministry of Labour by visiting Tahseel centre or call the toll free number 800 60.

Dear Questioner

We would like to have a look at the employment contract. Also, what was the reason for resigning?

It appears that this was a limited contract and you probably resigned before the expiry date.

Yes, Mr Ibrahim. It was a limited 3 years' contract of JAFZA.

I resigned because I was told to work on half wages which I simply denied and preferred to move out.

Since my exit in Oct, there is a delay in F&F, and all past 4-5 months I am not able to join anywhere and running without any income.

Now, finally they agreed, but again they want to reduce further by applying Art 116.

Although I have signed form 7 with F&F with them, after signing they intend to cut down further.

I want to take this on a different level to be precise with you. This is exploitation and abusing of the employee.
