الفصل التعسفي والتعويض بموجب قانون العمل الإماراتي

سيدتي العزيزة،

أدعى أر إس. أعمل مشرف صيانة المرافق في الشارقة، بالإمارات.

قام صاحب العمل الخاص بي بإنهاء عقدي غير محدد المدة بفترة إخطار مدتها شهر واحد (فصلًا تعسفيًا) وقدم لي جميع المستحقات مع دفع فترة الإخطار ومدتها شهر كامل.

طلبت من الشركة دفع تعويض لمدة 3 أشهر إضافية مع مكافأتي السنوية البالغة شهر ونصف.

لم توافق الشركة على ذلك وقد تقدمت بشكوى رسمية إلى وزارة العمل عبر الإنترنت، ولكن لم يتم حل هذه المسألة بعد، وحوّلت وزارة العمل قضيتي إلى المحكمة.

يرجى تقديم المشورة بشأن المستحقات الفعلية التي يجب أن أحصل عليها وفقًا لقانون العمل في الإمارات.

ومع هذا، فأنا أطلب على الأقل دفع تعويض راتب شهرين وهم لا يريدون الدفع.

هل تنصحين بحل مشكلتي في المحكمة؟ إذا كانت الإجابة بلا، فيرجى تقديم المشورة بشأن ما هو حقي وما هي الخطوات الأخرى.

Dear Questioner,

According to Article 122 of the UAE Labour Law, the termination of the employment of the worker by the employer shall be deemed arbitrary should the cause of termination not be related to the work, in particular should the termination of the employment of the worker be made by reason of the filing by the latter of a serious complaint before the pertinent authorities or a valid claim against the employer.

Where an employee is arbitrarily dismissed, the competent court may order the employer to pay him compensation.

Please note that the court shall assess such compensation with due regards to the nature of work, the amount of the prejudice he has sustained and his period of service, and after investigating the circumstances of the work.

The compensation amount shall not exceed more than three months calculated on the basis of the last remuneration he was entitled to.

Madam,

Thanks for your valuable time for my query.

I worked for 3.5 years in this company and the employer terminated for restructuring the business model not related to my work.

Every year I am getting a bonus and for 2018 I am approved for 1.5 months bonus.

Kindly advise for my total benefits. How much can I expect from the employer?

I am expecting 3 months' full salary compensation under arbitrary dismissal, 1.5 months bonus, notice period salary, gratuity, leave salary, one-way ticket.

Kindly advise. Can I get all the above rights? The employer's PRO said if I didn't accept what the company is providing me, they can forcefully apply for an employment ban.
