Verbal abuse case delayed – what are my options for resolution and expediting the process?

Hello,

A verbal abuse complaint was filed against me, though there are no witnesses and no direct evidence. There are a few indirect WhatsApp messages that may be open to interpretation.

The police filed a case and seized my phone. It has now been over three months. The police transferred the case to the public prosecutor; however, it was returned with a recommendation for settlement or referral to a one-day court.

The complainant previously refused to settle and now does not answer police calls. The police have now sent the case back to the prosecution due to a lack of response.

What can I expect next? How can this be expedited? What happens if this person does not reply to the prosecution either?

Hello,

In your verbal abuse case, the police have transferred the matter to the public prosecutor, who has suggested either a settlement or a one-day court hearing; however, uncertainty exists due to the complainant's refusal to settle previously and their current unresponsiveness.

The next steps involve the prosecutor reviewing the case, which may lead to dropping the charges if they find insufficient evidence or if pursuing the case is not in the public interest.

Alternatively, a one-day court hearing could be scheduled if there is enough evidence for further examination.

To expedite your case, consider hiring an attorney who specializes in criminal law to assist in navigating the process, following up with the authorities, and maintaining thorough documentation of all communications related to the case.

If the complainant remains unresponsive, the likelihood of case dismissal increases, which could also weaken their position if they later seek further action against you.

Staying in communication through legal representation can provide clarity and potentially expedite resolution as you await further action.

Greetings,

Since the police have referred your case to the public prosecution with a recommendation for settlement or a one-day court trial, here’s what you can expect next:

- If the complainant remains unresponsive, the prosecution may decide to close the case due to lack of cooperation.

- If the case proceeds to a one-day court, a swift judgment may be issued based on available evidence, including WhatsApp messages.

- Your phone seizure may continue until the case is resolved.

To expedite the process, legal representation can help follow up with the prosecution. Request case dismissal if the complainant remains unresponsive, and ensure your rights are protected.

Thank you for reaching out regarding your verbal abuse case, which has been ongoing for over three months.

Below is a breakdown of what to expect next and how to expedite the process:

1. Current Status & Next Steps

Your case was returned by the Public Prosecution with a recommendation for either settlement or proceeding to One Day Court.

Since the complainant is not responding, the police have sent the case back to the prosecution for further action.

If the complainant continues to ignore prosecution calls, the prosecution may:

- Dismiss the case due to lack of interest from the complainant.

- Proceed to One Day Court without requiring the complainant’s further input.

2. Can You Expedite the Case?

- File a Request for Case Closure

- Your lawyer can formally request the Public Prosecution to close the case due to:

  • Lack of direct evidence or witnesses
  • Failure of the complainant to respond
  • No further legal grounds to continue

- Request Immediate Scheduling for One Day Court

If closure is not granted, your lawyer can request an urgent hearing in One Day Court to resolve the case quickly.

3. What If the Complainant Does Not Respond to Prosecution?

If the complainant continues to ignore calls from the prosecution, the case may be:

- Archived and dismissed due to lack of evidence and engagement.

- Automatically forwarded to One Day Court for a quick hearing and judgment.

If the case reaches court, it will be judged based on the available evidence, which seems weak in your case.

4. Recommended Next Steps

- Engage a lawyer to file a request with the prosecution for case closure due to lack of evidence and complainant’s non-cooperation.

- If closure is not possible, request to expedite One Day Court proceedings to resolve the matter quickly.

- Follow up with prosecution regularly to ensure the case is not left pending.

Would you like us to assist in submitting a formal request for closure or case expedition?

Looking forward to your confirmation.

The case is back with the public prosecutor. If the prosecutor believes there is insufficient evidence to proceed (especially given the lack of direct evidence and the ambiguous WhatsApp messages), they may dismiss the case.

If the prosecutor believes there is enough evidence to proceed, they will refer the case to the one-day court. This court is designed for quicker resolution of minor offenses.

The complainant's lack of response significantly weakens their case. It suggests they are not serious about pursuing the matter or that they lack confidence in their accusations which will be in your favor.

We will discuss the possibilities in detail. Kindly share your WhatsApp number to proceed with us.

Thank you for reaching out with your inquiry!

Based on the details provided, I understand that you're facing a challenging situation involving a verbal abuse complaint, and the case has been transferred between the police and the public prosecutor.

1. Here’s what you can expect moving forward:

- Case Progression: If the complainant continues to refuse to settle and does not respond to the police or prosecution's attempts to resolve the matter, there are two possible outcomes:

- Prosecution's Decision: The prosecution may decide to proceed with the case despite the lack of settlement. The case may be moved to court if they believe there is sufficient evidence or that the situation warrants further legal action.

- Case Dismissal: If the complainant fails to respond to the prosecution or does not provide further evidence, the case may be dismissed or archived.

- Expediting the Process: You can potentially expedite the resolution by requesting a follow-up with the prosecutor’s office to clarify the status of the case and suggest that the complainant's lack of response may warrant dismissal. An experienced lawyer can also advocate on your behalf to speed up the process.

2. What Happens if the Complainant Doesn't Respond:

If the complainant continues to ignore the prosecution’s attempts, the case may not proceed to trial, as criminal cases typically require the involvement of the complainant. However, this could also lead to the case being closed due to insufficient evidence or lack of cooperation from the complainant.

Given the complexities of the case, I recommend scheduling a consultation so we can discuss your options in more detail and ensure that your rights are fully protected. I can assist in following up with the prosecution and exploring the best legal course of action.

Please feel free to reach out to me via WhatsApp, phone, or email to discuss this further and begin working on a strategy to resolve this matter.

Best regards,
