I resigned before completing 1 year. Am I still eligible for leave salary and gratuity?

Dear Lawyers,

I resigned before completing 1 year, but with a 90-day notice, I completed 1 year and 27 days. Am I still eligible for leave salary and gratuity?

Dear Questioner,

In the UAE, employees are entitled to leave salary even if they resign before completing one year of service.

The leave salary is calculated based on the number of days worked during the year. Since you completed one year and 27 days, you will be entitled to leave salary for that period.

Gratuity is a mandatory end-of-service benefit in the UAE. Employees are eligible for gratuity after completing one year of continuous service.

Since you completed one year and 27 days, you are eligible for gratuity. Check your company policy regarding the notice period.

If you need further clarification, you may ask us.
