Q: Hello,
I'm structural detailer/draftsman. My employer terminated me last Nov. 30, 2020, due to some mistakes of work.
But now more than 1 month already he doesn't want to cancel my visa and he told me to go back to my home country without cancelling my visa.
Otherwise, he will file a case against me due to my mistakes and he wants to deduct the cost of rework and material scrapped from my settlement (AED 15k of total cost) due to my mistakes.
Hope you can help me and give advice on what to do in this situation.

س: السلام عليكم أخي يعطيك العافية،
كنت أعمل في شركة خاصة وطبعًا الشركة توفر إيميلات تخص الشركة لجميع الموظفين في الشركة بأسماء الموظفين.
باعتباري موظفًا بالشركة، دخلت على إيميلات زملائي بالشركة؛ ولكن دخلت بطريقة نظامية بدون اختراق وذلك عن طريق الباسورد الذي حصلت عليه من أحد الموظفين الذي يعمل في الشركة مديرًا ماليًا.
الآن إدارة الشركة تريد أن ترفع قضية اختراق إيميلات ضدي بسبب أنهم دخلوا جميع إيميلات الموظفين ووجدوا أن الآيبان الخاص بهاتفي المحمول قد دخل إلى ثلاثة إيميلات من إيميلات الموظفين.
علمًا بأن باسورد الإيميلات الأخرى كان موجودًا على إيميل المدير المالي الذي أعطاني باسورد إيميله مسبقًا والآن ينكر أنه أعطاني إياه.
هل هذا يجرمني بشيء؟
علمًا بأنه كما ذكرت سابقًا، فإنني لم أخترق وإنما دخلت بطريقة نظامية. الشيء الآخر أنه تم إعطائي إنهاء خدمات منذ شهر ولم يعطوني مستحقاتي إلى الآن.
قدمت شكوى منذ يومين ضدهم في وزارة الموارد البشرية والتوطين. هل يمكنني إذا رفعوا قضية ضدي أن أقول بأنها دعوى كيدية وأرفع قضية مدنية ضدهم بطلب التعويضات لما سببوه لي من أضرار مادية ونفسية؟

What can my company do with me if the client penalized us for a mistake we made?

Q: Hi,
I am working as a mechanical engineer in a firefighting company in Abu Dhabi. I am in charge of and representing one of our sites and I am working inside the site.
Due to our mistake during maintenance, we created a fire alarm which results in the evacuation of around 450 persons for 20 minutes. Due to this issue, our client charged a penalty of around 40000 Dhs to our company.
Hence I need to know what actions can my company take against me.
Is it allowed for the company to charge a full penalty amount from me or will they terminate me without settlement if I am proven guilty?
If I need to pay the company some amount, what is the maximum amount I need to pay legally?
If I am planning to resign from my company, will they make any issues during visa cancellation?

Employee mistakenly submits documents, police case filed: What now?

Q: Dear Sir/Madam,
An employee submitted a document and its attachments to two municipalities to obtain an NOC from Etisalat for a plot.
The employee, who did not know much Arabic or the procedures in that municipality, mistakenly submitted an already filled-out form from another project (which had already been stamped by the municipality) and simply changed the project information and submitted it.
The employee later realized the mistake and corrected it in one municipality. However, in the other municipality, they took it as if the employee had forged the document and filed a police case.
The company blamed everything on the employee, even though it was not his job to submit these applications.
What will happen in this case, when it was all a little mistake? No one was hurt by it, and the project was not even started; it was just a land NOC.

Can my employer deduct money from my salary for an unintentional billing error?

Q: Hello,
I am working at a medical clinic in Dubai as a medical receptionist. Recently, our medical clinic received a 15,000 AED fine due to a small billing error I made unintentionally.
Now, the clinic is telling me that they will deduct 700 AED per month from my salary, while my basic salary is only 1,500 AED.
Is that legal in the UAE?

Our internal contract has a notice period of 3 months from both parties. In the new labor implementation, only one month's notice is required for less than 5 years of service.
Please advise if we can follow our internal contract since the position is very curtailed and the organization will not be able to replace the position within one month.

Annual leave salary calculation as per the new labor law.
Can you please clarify the correct annual leave salary rules?
Some say it is basic + HRA for the month you will take off, others say it is full salary, and somewhere I read it is basic + HRA (annual leave salary) plus the normal salary you get.

How to appeal the labor judgment if the court did not approve all my dues? 0
My employer has not paid my salary for 8.5 months. I went to the labor court, and was referred to Dubai Courts.
The judgment came and I did not receive the full claim including salaries and 3 months' compensation.
Please advise whether I can go for an appeal and what will be the time for execution.
