Proving the payment of rent to absconding real estate manager

Dear Madam,

I am staying in Dubai.

I had a rent bounced cheque due to the account being closed. I paid the bounced cheque amount in cash to the manager but he is absconding now and without giving me the receipt.

Now the rental agency has opened up a case against me in the police. I am going to meet their lawyer. Need your advice on the correct procedures to follow in this case.

How can I settle this dispute?

After reading your query I understand that your cheque which you has submitted for rental has been bounced and you had made this payment to the manager of the company.

The manager collected this money and is now absconding and the company is behind you for the collection of this amount.

Please give clarity to the following questions for me to have a more clear idea about your situation:-

1. What was the mode of payment?

2. Where did you make this payment? In office premise or outside?

3. Do you have any proof of such payment you made to the manager?

Thank you for your reply. Please find the answers below.

Mode of payment- Cash

Location of payment- Ground floor building reception

Proof of payment- No receipt as he promised he will give me later but didn’t. Only my bank statement which shows a debit of the cheque amount.

So basically I am duped here.

Also, my worry is if I require a police clearance certificate or any background verification check in future, will this police report create any trouble even if I pay the fine and settlement?

If you do not have any proof, you may speak to the company and try to negotiate and settle the matter amicably.

Please request them to check the CCTV [if any] so that the concerned can see the transaction happened on so and so date at the ground floor reception of the office building.

Have the [real estate company] already filed a criminal case against you for cheque bounce?

If yes, then settle the same as soon as possible by paying the fine. Please note that this will not create any problem in future.

Thank you very much for your quick response.

I will settle the case ASAP by paying the fine amount. I will also try to negotiate with the real estate company's lawyer on the settlement part.
