Questions & Answers
Why did my employer falsely file an absconding case against me?
Dear Sir/Madam,
Before my visa expired, I informed my manager and the owner that I did not want to renew it. I have all the proof that I left the job and the accommodation with the owner and manager's approval.
However, after a few months of waiting for my cancellation papers, they falsely filed an absconding case against me, which they later removed, citing a filing error and miscommunication with the owner's staff.
Is there any reason for the employer to do that? Could it be to avoid fees or something else?
Please help me!
Dear Questioner,
It's concerning that your employer initially filed a false absconding report against you, especially if you had already informed them of your intention not to renew your visa and had approval from the manager and owner to leave the job and accommodation.
While I can't definitively speculate on their motivations, there could be several reasons why an employer might engage in such behavior:
1. Financial Considerations:
Some employers may attempt to avoid paying certain fees or penalties associated with the cancellation of an employee's visa. By filing a false absconding report, they may hope to expedite the cancellation process or avoid administrative costs.
2. Administrative Errors:
It's possible that the false absconding report was the result of administrative errors or miscommunication within the company. However, it's concerning if this occurred despite your prior communication with the manager and owner.
3. Mismanagement or Misconduct:
In some cases, employers may engage in misconduct or mismanagement, such as filing false reports, for various reasons. This could be indicative of broader issues within the company's management or culture.
4. Legal Compliance:
Filing false reports or engaging in deceptive practices is not only unethical but may also violate labor laws and regulations. If you believe your employer's actions were unlawful, you may consider seeking legal advice to understand your rights and options for recourse.
Given the circumstances, it's crucial to document any communication or evidence related to your departure from the job and accommodation, as well as the false absconding report filed against you.
If you encounter any further issues with your employer or the visa cancellation process, you may consider seeking assistance from legal or government authorities, such as the Ministry of Human Resources and Emiratisation (MOHRE) in the UAE, to address your concerns and ensure your rights are protected.
If they filed the absconding due to negligence on their side, they can be fined by the Ministry, and you can report this incident.
However, did you serve your notice period as per the MOHRE contract after resignation?
