Fine payment and liability to pay the cheque amount

Dear Questioner,

Please be informed that your liability to pay the outstanding will not end if you pay the imposed fines during a criminal case associated to cheque dishonour.

The punishment in the criminal case is for issuing the cheque in bad faith. This will not take away your liability to pay and settle the debt. The debt is always a debt.

You will always have the civil liability to pay and settle the outstanding amount and your creditor has the right to file a civil case against you to recover the amount.

If you are not able to pay, the other party can take steps to attach your assets and even you may be inflicted with a travel ban or blacklisting.

As a general practice, when you apply for a loan, you have to surrender a guarantee cheque for the same amount or a blank cheque. Bouncing of a cheque up to AED 200,000 or less is categorized as a “simple crime” holding the penalty of a fine not exceeding AED 5,000 to AED 10,000 as per latest developments. Please be advised that payment of fine will not remove the travel ban.

Outstanding loan is a civil liability for which your creditor has the right to file civil case against you. You may not be able to renew your current employment visa or secure a new one until settlement of the outstanding debts between both parties. It is advised to approach the creditor for settlement of the outstanding in shape of installments at your earliest to avoid any further problems.
