Failure to pay instalments of a business loan and house mortgage
I have a house in Dubai worth 6 million (mortgaged 3.8 million). I am an investor and have taken a business loan of 2 million. I want to sell the house but the real estate market is slow.
Business is slow. If I am not able to pay the business loan EMI on time, what will happen? Will the bank give me time to sell the house and regularise the EMI payments?
Dear Questioner,
If you stop making the instalments towards your mortgage, the bank will start applying extra penalties and interests for a while (3-6) month while they will communicate with you and ask you to pay.
If you continue without paying, they will forward the file to their collection and legal department until it results to complete forfeiture of the property.
The bank is then free to do what they want with the property to receive their loan back in addition to the penalties, interests, and legal expenses.
I advise you to negotiate with the bank based on your mortgage agreement an amicable way to reschedule the loan or even to sell the mortgage to another bank who might give you better repayment conditions that fits your current financial abilities.
Let me know if you wish to sit down and discuss the subject, we can as well negotiate on your behalf with the bank or refer you to our network of bankers.
