What can I do after I get a labor case judgement to get my dues and cancel my visa?
Dear Professionals,
My case in Dubai Courts is set for judgment. I have a few questions what will happen after the judgment?
1- How can I cancel my labor card and visa?
2- I have a fine on my labor card due to the non-renewal of my labor card by the company. So who will pay the fine? If I go to MOHRE for the cancellation of the labor card, will MOHRE ask me to pay a fine?
3- I came to know immigration department will not cancel my visa without my employer so please advise me on what to do if my employer does not agree to come to immigration for cancellation.
4- When can I apply for execution to get my dues (before labor/visa cancellation or after)?

1. You can request from MOHRE, now that your case is before the court, to cancel your visa.
2. The employer will pay.
3. If you file a case before the court, it can be canceled without the employer's consent unless the employer files a criminal case for cheating, fraud, or theft.
4- EXECUTION APPLICATION: The winning party can apply for execution with the court through its lawyers or Ontime after the grace period of 30 days expires after serving the judgment.
This application formally requests the court's assistance in enforcing the judgment, and you have to wait another 7 days after the summons for the execution case has been served.
The service of the summons is the longest process that involves attempts at personal service, pasting the summons on the door, service by email, and lastly, publication.
5- SEIZURE OF ASSETS: An application to the court may be filed to attach the trade license, another to attach the bank account, and another to seize the assets of the losing party to satisfy the awarded amount.
This can include freezing bank accounts, placing liens on properties, or taking possession of other assets to fulfill the judgment. Lastly, an application may be made for an arrest order and travel ban for the manager.
Caution and Advice: It's important to recognize that filing a case and obtaining a judgment do not guarantee immediate payment.
So please move on with your life and find a job to sustain yourself. Recovery of dues depends on the employer's financial situation and willingness to comply.
If the employer is operating a business and is concerned about the potential consequences of non-payment, they may be more likely to settle the dues.
But if they are absconding and working under the umbrella of another entity and are unconcerned if their bank account is frozen or their trade license is blocked, then it will be very difficult to recover your dues.
