Q: I purchased an off-plan property in Ajman back in May 2007. I was supposed to possess the property by the end of 2009. Till now, the tower has only two floors above the ground and it seems that the construction stopped at that level. I have paid almost 80% of the total value. I tried several times to reach the Developers, but they are not responding to my emails and phone calls. What can I do in this situation, and do I have any chances to take my money back? Q: Delay in property completion and need for cancellation and exit from SPA Hello All, I booked for an off-plan property in Downtown Dubai by a leading builder. The completion date was June 2018. However, the property was not completed in June of 2018. I received a note in April 2018 citing the new completion date would be Dec 2019. Since the completion date is well over the stipulated grace period in SPA, I had requested the builder for a friendly settlement by cancelling the SPA and refunding the money as per the default by vendor clauses in the SPA. This has been refuted by the builder and repeatedly says that they cannot cancel the SPA and neither can they refund the money. What are the options available?

Q: I have bought three apartments in a project and the delivery date was in 2018. I have paid 100% and nothing is pending. The builders informed me that the delivery will be in July 2019 but now they are saying the end of Dec for one apartment and the rest in 2020. If I want to withdraw and cancel the contract, can I get the complete refund and will I receive the interest too?

Q: I had invested in a project in Dubai in Oct 2018, in a 3 bedroom townhouse. I have paid them 24% of the house amount till now but haven't received anything except for SPA and receipts from them. No registration of the property has also been done wherein we were supposed to get the house in Dec 2019 the handover. On checking, we got to know that they haven't even got permission from the land department for that particular row of townhouses in which we had booked our unit, and no construction has also happened till now. They offered us another unit instead to take which they claim will get finished in Dec 2020. But because they have been lying to us since the beginning and have taken money from us without any permission being in place, we want to exit from the agreement and get our money refunded. Wanted to know what are we eligible to get money in this case? Seeking the correct advice. Please help.

Q: Dear sir/madam, I bought an apartment. I paid 90% of the total amount. In the final stage to receive the apartment, the size was different and I asked many times about this issue, but no one answered. Now, they tell me that they took it without any reason.

This Law establishes interim property register in which sale contracts, off-plan sales, and other off-plan legal dispositions of real property are registered prior to inclusion in the property register maintained by Dubai Land Department.

The provisions of this Law supersede articles (2) and (11) of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.

This Resolution approves the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.
