Claiming unpaid salaries and entitlements from absconding employer
Hi
I filed a case in the labour office for non-payment of salary for the last 3 months, but when the labour office tries to call my employer on his mobile it is switched off.
At the same time, the company trade license had expired already and the employer doesn't want to renew it. He wants to shut down the business.
In this case, is there any hope that I will get my salary? Can the labour office help me to get all my settlement?
Advise me, please.
Dear questioner
What the Ministry of Human Resources or the Labor Court can do is to help you get your rights by issuing decrees to protect it and accept your case and issue a verdict in your favour to get your legal dues.
However, if the company is shut down and the employer escapes the country and becomes unreachable, no one will be able to help you.
Even if you have a court verdict that says you are eligible for your salary and compensation but there is no money to chase, no one will be able to help you.
On the other hand, I do not advise you to give up your rights. You just need to manage your expectations.
