Overstay payment liability during the visa transfer

Dear questioner,

If you have signed the offer letter and employment agreement before you overstayed and given the company a reasonable time to process your visa, the liability falls on the company as they have caused the delay in the process that led to the overstay.

Otherwise, it will be your liability. But in most cases, the company does not require such a payment from the employee especially at the beginning of their relationship.
