The final supply was to be done to the India Telecom over a 5-year period at 2,200 units per year, based on a purchase contract signed between us and another company. Based on this agreement, we placed an order for 2200 units at a value of AED12,273,400 (Twelve million two hundred seventy-three thousand four hundred). Based on the purchase order, the other party made a payment of 15% as a deposit and we finalized and handed over, but they didn’t pay since one year. Q: I run an architectural firm in London, UK. One of our clients is a property broker based in Dubai who also has a UK based company that was set up specifically to pay our fees. He is the director of the UK company as well as the Dubai company. His company is refusing to pay us £12,000 that has been owed for work we completed over 12 months ago. Is it possible to lodge a claim against him personally in Dubai as I have a feeling he will just shut down his UK company if I pursue it through the UK courts? If so, what is the process and how much would the legal and court fees be? We have a contract signed by him, but on behalf of his UK company, and a lot of correspondences between us and his company trying to recover the money.

Q: Dear Mrs Khan, I have recently received a Post Dated Bank Cheque from one of my new clients, the cheque date is Thursday 19th Apr 2018. Today, I called this client to find out that they are not answering calls, and when I went to their office I found it closed and many of their suppliers in the corridors complaining about their Bank Cheques that were bounced back (rejected). The owner of this company seems to have already left the UAE and none of his employees is answering the phone. So most probably the bank cheque that they gave me (AED 57250) will bounce back Thursday. So I want to start taking action now. I sold them 10000 boxes of 15 Kg lemon, which they stored in a third-party cold storeroom in Dubai. I went and found that the lemon is still there. Please, could you tell me how can I legally get back my lemon as I'm 100% sure I will not be paid? Thanks in advance and please feel to ask should you need more details.

(بالتضامن والتكافل). صدر منطوق الحكم "بإلزام المُدَّعَى عليه بسداد مبلغ وقدره (.....) والفائدة القانونية (......) وأتعاب المحاماة (......)". السؤال هنا عن إمكانية تحديد المبلغ المترصّد على مُدّعَى عليه واحد فقط؟ وكيف؟

Q: There is a company in UAE dealing in assured monthly returns, and fixed interest. They format a proper contract and give security cheques for principal and interest amounts. My contract is finished and I am asking for the principal maturity amount. The company is giving new dates every time and not releasing the maturity amount. Should I deposit the security cheque? What will happen if the security cheque bounces? How to legally deal in such a scenario.

Q: Dear Lawyers, Conditions for placing the manager of a debtor company in jail. Article 322 of UAE Civil Procedure law states as follows: "If the debtor is a private legal entity, the order shall be issued for the imprisonment of who represents the company legally or any other person if the refusal from execution is attributed to them personally." Does "the refusal from execution is attributed to them personally" apply only to "any other person" or also applies to "who represents the company legally"? If I ask for the detention of the manager or partner of a company, have I to prove that the manager/partner is refusing to execute the writ? This is a general question regarding the interpretation of the law. It is not linked to my cases or documents.
