The landlord is insisting on a 70% rent increase or eviction. What to do?

Dear Lawyers,

My landlord gave me a court-notarized eviction order to sell the apartment. However, the landlord has not sold the apartment yet and the notice expiration date has passed.

He offered me to stay, but only if I agreed to a 70% increase in rent, despite the RERA index showing a 0% increase.

I made an offer and deposited it in RDC, and the judge ruled in my favor to renew my lease on the same terms for one year. I sent this ruling to the landlord and confirmed that the cheques for rent are ready for collection.

However, the landlord is now threatening me with legal action, forced eviction, penalties, and damages.

Can the landlord still evict me without selling the apartment, despite the RDC's order for a renewal on the same terms?

Hi,

Pursuant to your query, since the RDC has already given the ruling in your favor, you can notify the RDC that the landlord is not accepting the order and can ask the RDC to renew the tenancy contract.

The tenant can not evict you since he is not selling the unit.

Can you please clarify:

1) Will the landlord have to prove the actual sale MOU or he has to only show intention to sell to stop the renewal of the lease? (1 full year he has not sold and even has no buyer).

2) How much will the legal fees be for your firm to handle the entire matter and get the renewal done from RDC on my behalf?

Yes, he needs to notify you about the sale. How much is your new rent as per RDC?

Since the RDC has already given the order in your favor, you need to visit the RDC and submit the cheques as per the tenancy contract. The RDC will send the notification to the Landlord.

At the same time, you can also send an email to your landlord to renew the tenancy as per the contract.
