Q: Divorced Muslim wife brings her boyfriend home where my young son lives and she drinks alcohol.
Now, she lost her home due to rent delays that she didn't pay and she travelled with her boyfriend for a vacation outside the country and left my son with me.
Kindly advise how to drop my son's custody from his mom.

Possibility of changing custody in case of changing country

Q: I am a US citizen (father of a 9-year-old).
I recently got divorced and have sole legal and primary physical custody of my child. My wife is allowed only 1 visit with my child (for 2 hours each week, under the supervision of a 3rd person).
My wife has unaddressed mental health issues. This is documented in the Parenting Plan and Divorce Decree.
If I move to outside the UAE, can my wife again file for revision of custody?
Will my US divorce and parenting plan be considered by the courts in the UAE?

س: السلام عليكم ورحمة الله وبركاته،
السادة الأساتذة سؤالي هو:
كيف يمكن الإثبات قانونًا أمام المحكمة أن الأب لم يرَ أبنائه الصغار ولم يسأل عنهم قط (بمحض إرادته) منذ حوالي 3 سنوات.
الإثبات مطلوب لتفويت الفرصة على الأب إذا ادّعى مستقبلاً أن أمهم حرمته من رؤية أبنائه.
الأم مطلقة منذ حوالي سنة.

خرجت الزوجة من بيت الزوجية بدون علم وإذن الزوج ولمدة 8 أشهر مع فشل كل محاولات الصلح وأخذت طفلها معها.
هل يجوز أن يكون ضمن طلبات دعوى الطاعة الزوجية إلزامها بتمكين الزوج من رؤية طفله؟
علمًا بأن الطفل عمره أقل من سنة.

Can the wife prevent the husband from seeing his daughter during divorce case and custody?

Q: I am a husband going through a divorce case in the Dubai First Instance Court and with a 10-year-old daughter.
I have some questions about my rights as a father:
1. What are my rights regarding child custody during the First Instance and Appeal stages of the divorce case?
2. Can I meet my daughter before the final judgment is issued? Are there any conditions or limitations for these meetings?
3. If my spouse has custody of our child and refuses to disclose her location, can I take any legal action for Child Abduction?
4. Can my spouse restrict my communication with her and her family members? Can she enforce a specific mode of communication, such as email?
5. Can my spouse make decisions regarding our daughter's schooling without my permission?
I would appreciate any guidance on my legal options in these matters.

Is the appeal court's decision implemented automatically, or is an execution procedure required?

Q: Hello,
I kindly ask for clarification of the following situation:
The Dubai Family Court of First Instance gave the father visitation rights, and he has a Sharia Execution Case for implementation.
At the appeal, it was a tragic verdict: the judges rejected his visitation rights because the marriage was invalidated due to religious differences.
- Is this decision implemented automatically, or is there an execution procedure, with an execution writ, similar to the first instance?
- Is it possible for the father to still meet the child until the execution procedure is completed?
- Does Chapter 5 of the Federal Decree by Law on Promulgating the Civil Procedure Code, which deals with Executing Execution Writs and Decisions Related to Personal Status Matters, apply to the appeal or only to the first instance?
