Filing a case for recovery of dues from a company
Hari,
I posted earlier regarding my dues. I have yet to receive an amount of around AED 80,000 from a DFM listed in Dubai. This is the Board Fees due, since 2014-15.
I sent reminders, no response from the company. I was serving as MD & CEO of the company then. Resigned as MD & CEO on June 15 and as Board Member on Jan 16.
How can you help me recover this amount asap? What's the process and what's the cost? How much time may it take?
Let me know.
Best wishes,

Dear Questioner,
Thank you for getting in touch with me regarding your query.
As you've stated, you are entitled to receive board fees from the company and even after several reminders, the company has failed to honour the dues.
In this case, you will have to file a civil case against the company before Dubai Court. We will have to prove three elements i.e. Liability, Causation and Quantum of loss.
After perusing the documents, we will be able to achieve all the three elements and successfully claim your dues.
The timeframe in these cases depends on how complex the issues are and how the defendant i.e. the company responds to this litigation.
I recommend that you email me the documents/ correspondences between you and the company in relation to your claims and thereafter a concrete roadmap can be prepared to recover this claim.
Please email me the aforementioned documents on hari@alnassaradvocates.com and I will get back to you.
Regards,
Hari Wadhwana
