Q: Dear Sir,
My brother was involved in an incident at his company that claimed two lives (the victims died in a sewage tank).
During this process, my brother happened to be a safety officer in that company but the supervisor and the managers assigned those workers who died during the cleaning of the sewage tank without informing the safety department.
During the police investigation, my brother's passport was seized by the police and the case was referred to public prosecution.
After the final investigation, my brother (safety officer) was not guilty as the public prosecutor decided, but the supervisor was guilty since he gave the order to those workers to carry out the unsafe work without informing the safety department for proper risk assessment.
The supervisor was given a 5-month jail term. Concerning my brother, his case ended at the public prosecution office since he was not guilty, but since then, his passport is still held with the court.
Please, I need advice.
Thanks
Taka Farhad

Possibility of bail in case of detention for construction site accident
5
Q: Dear Sir,
I have my friend in detention in Al Barsha police station for accidental death in a construction site. His team on site had employed fewer labours for work and one of those guys died in an accident.
The police had detained my friend as he is the owner of the company. The police case report number is only available and they have not still transferred it to the public prosecution.
Is it possible to get bail before the case being transferred?

Defense in case of work site accident and full recovery of the victim

Q: My husband is a civil site engineer at a private company in Dubai. In Feb 2019, a labourer fell from the 1st floor above and had a minor injury which was treated 15 days in the hospital and discharged.
The labourer flew to his home country later (May 2019) and didn't return to the UAE at his own will. He is hale and hearty till date.
The passports of my husband and 2 of his coworkers were confiscated by Police soon after the incident.
In a court proceeding, they demanded that the injured victim is proved to be healthy. The company legal team handled the case & contacted legal firms in the victim's home country, made documents &video of the victim to prove he is fit and healthy.
The case was dismissed at Dubai court. The public prosecutor appealed against the judgement.
The latest judgement given is embezzlement of funds/bonds handed over to him in prejudice to those entitled to them (breach of trust).
How is the breach of trust and embezzlement imposed on this case? Why should my husband & his co-workers face any punishment without any fault?

How to remove travel ban after closing a case for an accident on work site
2
Q: Good Morning Sir/Madam
My name is S. and I am working in safety. There was a fatality at my site and a worker died. I was in Al Rashidiya police station and was released after two days after my passport was kept in the station.
After two years, the police called us and informed us to collect the passport. The police prosecution didn't give any other documents but released our passport and said no more case.
But when I was about to cancel my visa, the office at FAIC said that there is still a case under my name and I can't travel.
Please advise, Sir.

How to lift a travel ban placed after a work site accident and injury

1
Q: One year ago, an accident happened at my site. A laborer's both hands were fractured during marble unloading and I took to him to hospital.
I was helping him even he was not working under my department. But when the police came, they took my ID and details. After that, there was no follow-up.
The company paid the hospital expenses and gave him the job back after sick leave.
Now the situation is that I resigned from the company and I was traveling back to India. At the airport check-in, they told me I have a travel ban.
How can I close this case and lift my travel ban?

How can I remove a travel ban and fine in a criminal case to go to my home country?

5
Q: Hi.
I am having an ongoing civil case in Sharjah. I need to travel to India because my father passed away yesterday. Therefore to do the last rites, I really have to travel to my home country.
But the problem I am facing is that I have a pending fine to be paid in the criminal court which is 100,000 with which I have a travel ban.
I have done nothing wrong to the company that I was working for but I still have gone through so much such as being put in jail for 8 days, not renewing my visa, and taking money from my account.
I haven't worked for the last 2 years and all my savings that I had in this country were all put to run the case.
Could anyone let me know if there is any possibility to reduce the fine imposed on me?
Thank you.

Can I cancel my house sale contract without extra fees after personal plans changed? 0
Dear Lawyers,
I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August.
Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F.
The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer's real estate commission and the conveyancing fee.
Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this?
Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?
