Q: My query is about mutual consent for divorce, I would like to know more info about this.
My husband and I have been separated for 7 years now since 2013. We tried to reconcile but it was not successful.
We both are here in the UAE until now and have different lives already, we have 1 daughter in the Philippines under his mom's care.
Support comes from both of us. We talk once in a blue moon if it concerns deeply our daughter. No idea where he lives now in the UAE.
I communicate with my daughter through my mother in law. We do not have a joint savings account or property in the Philippines.
A long time has been wasted. I would like to file for Mutual Consent for Divorce so my name will no longer be associated with his and we both can move on legally.
Please also advise roughly on the cost of the consent for divorce.

Q: Dear Team,
I would like to know what might happen in the conciliatory procedure. I filed a divorce against my husband and I was called for an appointment. I assume it is for this procedure. Please advise.
How can I draft a settlement agreement? How much possibly it might cost if I will consult a lawyer about this? Maybe you can refer me an adviser with regards to this concern that can charge me less.
I am just a normal worker seeking justice for my child.

What happens when trying to settle a marital dispute?

Q: Dear Sir/Madam,
I got divorced 2 years ago, and now my ex-wife has registered a "Marital Matters Non-Muslim" lawsuit against me. It is currently in the "friendly settlement" stage at the "Correction and Guidance Department" under the control of a "reformer family counselor."
Question 1: I have heard that there are two types of settlement attempts. The first attempt is made to settle, and if settlement is not reached, no further action is taken. The second attempt is made to settle, and if settlement is not reached, the litigants are given a paper authorizing them to start a lawsuit in the personal status court. Which of these types of settlement attempts does this current lawsuit fall under?
Question 2: Is it possible to claim lack of jurisdiction at this stage?
The matter that my ex-wife has raised is related to a loan that I gave her. Loans are not controlled by personal status law, even if the loan was between spouses.

Can an agreement be nullified for not knowing the language and signing it under coercion?

Q: I have a question.
I was forced to sign an agreement. It was in Arabic and I do not understand nor speak Arabic language.
I was not offered any translator or legal advice before signing the agreement.
I wish to know if such an agreement can be challenged in court and if I can defend it.
The situation was such that I was threatened to sign the agreement or else I was that there would be consequences.

How can I reach a settlement with the bank for a mortgage of a jointly owned property? 0
I have a jointly owned property in Abu Dhabi. The mortgage was defaulted on as I had to leave the property with my children following an assault by my ex-husband. He left the country in 2018 and never paid the mortgage.
As I was in the country, the bank filed a criminal case against me, and I was sentenced to 3 years. I won the appeal against the bank and then filed another criminal case a few months later in Dubai. Again, I won and paid a fine.
In 2019, the bank started a civil case against me and my ex-husband to have the property repossessed. However, at the time of the purchase of the property, there were no Title Deeds, the bank requires this.
I cannot give them the Title Deeds to sell the property and pay back the amount owed to them as my ex-husband refuses to provide a POA. The bank has filed another criminal case against me only for our jointly owned property.
I wish to resolve this and pay off the bank and receive any money left from the sale. How can I resolve this issue of the Title Deeds?

Can a real estate agency hold a percentage of a property sale until transfer is done? 0
A real estate agency has signed an MOU stating that a 10% security deposit from the buyer and the seller will be kept in the real estate agency and will be released upon transferring the property.
The transfer of the property was blocked due to the court order.
According to my colleagues, the real estate agency is not a trustee and they are not allowed to have taken my security check in the first place, is this correct?

Our company (Ajman Freezone) has delivered goods to a company in Mainland Dubai.
The payment terms agreed on 30% on order confirmation and 70% on delivery of goods to the warehouse in Dubai.
The customer paid 30% on the order confirmation and failed to settle the 70% on delivery of the goods to their warehouse. Upon confronting the customer that he failed to comply with the payment terms, he asked to pay in installments.
We agreed on five monthly installments and the customer confirmed the date and amount of the payments via email.
Oct 2020, November 2020, December 2020, January 2021 and February 2021.
He failed to pay December 2020, January 2021 and February 2021.
Since then he has been avoiding us, and only when we keep pressuring him, he pays small amounts, which are not equal to the monthly installments agreed upon.
The installments were confirmed, but not handed over as PDC.
Kindly advise what can be done in this case and if it is feasible to go to court.
