كيف يمكنني المطالبة بمستحق نهاية الخدمة إذا انتقلت مع نفس الشركة من الإمارات إلى ألمانيا؟

انتقلت من الإمارات إلى ألمانيا تحت نفس الشركة بعد أن عملت لمدة 7 سنوات في دبي. قبل أن أنتقل، طلبت مكافأة نهاية الخدمة.

رفضت الشركة لأنه يبدو أن المكافأة تُدفع عند إنهاء العقد فقط، وليس عند النقل داخل نفس الشركة.

طلبت مني الشركة التوقيع على خطاب للتنازل عن مكافأة نهاية الخدمة مقابل ترحيل سنوات الأقدمية إلى ألمانيا عن نفس السنوات التي خدمت فيها في دبي.

هل أخطأت عندما وقعت تلك الرسالة؟ هل هذا طبيعي؟

"سنوات الأقدمية" لا تعني شيئًا في الواقع.

Dear Questioner,

Even if you signed the documents, but in fact didn't receive them, you may still submit a complaint to the ministry of labor, to receive your dues.

What about the "Gratuity is payable on the termination only"?

Is this in the law?

There is no such a term in the law, but the full-time foreign worker, who completed a year or more in continuous service, shall be entitled to end-of-service benefits at the end of his service.
