Can I file a criminal case for adultery against my husband without filing divorce?

My friend is a Muslim Indian woman. She has 3 kids. She discovered that her husband is having an affair with another woman and he is not willing to stop this relationship.

Now he left his house for one week and has not taken care of them. We want to file a criminal case against my husband and that woman. We don't want to file for divorce.

I have pictures of my husband with that woman, close pictures, and some messages.

What will the consequence of a criminal case for adultery be as per the new law of the UAE?

If I file a criminal case, is there any chance to waive the complaint if my husband stops that relationship with that lady?

Please help me!

Hi,

Yes, you can file a case. Under the UAE law, having extramarital affairs is a breach of the criminal law and can lead to serious consequences.

When filing a criminal case, you must possess admissible evidence, including written records and eyewitnesses (if any) against the accused.

The conviction will depend on successfully proving that the accused is actually having an extramarital affair.

If you want to file the case, we can do that. Just let me know if you want to proceed with it.

Thanks
