Eligibility for EOSB without paying compensation in resignation from limited contract
Dear Sir,
Good afternoon,
First of all, thank you for helping people by giving your expert advice, really appreciated.
My name is B. T., working with a private company in the Emirate of Abu Dhabi since Sep '20. I am having a limited contract for two years which is going to end on Sep. '22.
Now, I want to switch the company and I am planning to resign from this company in the month of April ’22 (4-5 Months before contract completion) and I will serve 1 month's notice period as per the contract.
So I want your advice on the below matter (Considering the applicability of Labour Law).
Would I need to pay 45 days’ salary to the current company?
What is the eligibility of compensation (Like Gratuity / Leaves) plus any exit process formalities I should follow?
Thanks in advance for the support.

Hello,
As per your contract, please note that you can resign. However, you do not have to pay, if you provide a one-month notice and do your duties.
Also, you will be eligible for the salary, for which you are working. The EOSB shall be calculated as per your last basic salary for the limited contract.
The EOSB will be as per the monthly basic salary / 30 x21 x no.of years in service.
