Can the employer sue the employee after settling and hold his passport?

My ex-employer filed a financial crime and we settled it before canceling the visa.

3 months after he canceled the visa, he filed the case.

What is the accusation?

22 Feb 2022, 22:34

In the public prosecution, they told me it's financial crime of 33000.

Dear Questioner,

Let me clarify, you had a financial debt with your employer for AED 33,000, which you settled in the first case?

By means of cheque, debt receipt, cash... etc?

And 3 months after the cancellation of your visa, he filed the same financial case?

Please be more precise so we can assist you.

Regards

Yes.

Seizing of others money.

24 Feb 2022, 18:12

The first case was closed because of the employer dropping charges or because of lack of evidence?

24 Feb 2022, 18:40

Ok, thank you, Ma'am.

So how will I get my passport?

24 Feb 2022, 19:35

If the employer is holding your passport, file a complaint at the police as no one is allowed to hold your passport unless it is a government authority and for a valid reason.

24 Feb 2022, 19:51

No, my passport is in the police station.

24 Feb 2022, 19:53

For the above-mentioned case.

24 Feb 2022, 20:20

If it's with the govt authority, then you must wait and let them know that the same case was earlier settled and it was closed.

So basically, your employer is proceeding with the same complaint twice.

24 Feb 2022, 20:33

Ok, Ma'am.

Thank you.

24 Feb 2022, 21:10

No Ma'am, I have only one case.

On 11/01/2022 there was a finance expert meeting. After that, there was no message or call.

In this situation, what do I have to do?

24 Feb 2022, 21:20

Visit the police station and require on the status, maybe the case is already dismissed or moved to the court.

Thank you.
