Questions & Answers
Do you have to compensate the employer for early resignation due to salary non-payment?
My contract is unlimited and the company did not pay more than 5 months, sadly.
Do I still have to pay early termination fees (45 days of salary) to the company?
Please help.
Thanks.

Dear Questioner,
Under any situation, no money shall be paid to any employer in this regard anymore unless a court order says so.
Your case is a legitimate reason to leave the company immediately and without even giving notice.
Then, you will have to file a complaint at the ministry of labor against the company which will be referred to the court and you will get all of your pending salaries within the month.
According to the Labor Decree-Law n. 33, Article 45, S1 gives you the right to leave the company if the employer did not fulfill his obligations towards the employee where the salary is a fundamental one of them is.
