هل يستطيع موظف دفع المبلغ المحكوم به في قضية عمالية قبل فتح ملف التنفيذ؟

مرحبًا سيدي،

أريد الحصول على مشورتك بشأن الموضوع الوارد أدناه.

هناك حكم مدني صادر ضدي بدفع مبلغًا من المال للشركة التي كنت أعمل بها. يمكنني سداد المبلغ المحكوم به.

ولكن سؤالي هو؛ هل يجب عليّ الانتظار حتى يقوم صاحب العمل برفع قضية لتنفيذ الحكم أم يمكنني سداد المبلغ قبل ذلك؟

يرجى تقديم المشورة.

لقد حصلت على عرض عمل ولذلك أحتاج إلى إنهاء هذا الأمر والانضمام للعمل بعد إلغاء التأشيرة. أقيم في إمارة أبو ظبي.

Hello,

As you have a case where you have lost, so it is better to pay the employer a one-time settlement before they file the execution and take the new job offer.

Normally, people are saying it's better to pay the amount in court than pay it to the company.

When I checked with the Injaz office they said I need to wait until the employer filed execution.

I doubt that advice and that's why checking with you.

Yes,

It is better to submit it in court.

However, you can make a settlement agreement, mentioning the one time payment and that they will not file the execution and mentioning all the required clauses.

However, if they still file the execution, you can deposit the settlement agreement. It is better to do it through a lawyer or else you can notarize or witness the agreement.
