CHEQUE BOUNCE CASE (PERSONAL CHEQUE) IF AN INDIVIDUAL FILE A POLICE CASE
1) What will be the minimum jail terms for Cheque bounce case? During jail terms whether he will be on travel ban? During jail term whether he can come out of jail by giving somebody's passport as security? After completing the jail term whether he will be still on travel ban as he has not paid the money against the cheque? If he did not pay the money during police case, how can I get back the money?
2) When he is on jail terms during police case, whether we can proceed with the civil case for cheque bounce?
3) For proceeding civil case whether we have to deposit any amount to court?
Your valuable advice will be highly appreciable.
Thanks

Dear Sir/Madam,
I hope you are doing well. With regard to your questions, I would like to clarify the following:
1. Minimum Term:
It depends on the amount of the cheque and the type of transaction, however, according to our experience, most of the applicable judgments for bounced cheques these days shall be only fine of AED 3,000 or AED 5,000 for cheques that less than 70,000 and for cheques more 70,000 it might be jail for one month to three months and the other essential factor is whether the cheque is a debt or made during a commercial transaction.
Ban:
2. The ban shall be issued automatically upon filing the complaint before the police station and shall be removed upon settlement or completing the term of imprisonment.
3. Once he is in the prison, he would not be out only if he finishes the term or he settles the debt with you amicably.
4. You may proceed with the civil case, directly, during and/ or after the criminal case.
5. Court Fee:
Yes, you have to pay court fees to Dubai court which is 6% of the claimed amount with a minimum of AED 500 and not exceeding AED 20,000 for the cases the claimed amount of which is less than AED 500,000 and a court fee of AED 30,000 for the cases the claimed amount of which between AED 500,001 to AED 1,000,000
For any case the claimed amount of which is AED1,000,000 the court fee shall be limited to AED40,000.
Best Regards,
Aws M Younis
