Q: Hello.
I filed a labour case last year against my old employer; I'm still on their visa which expires next month.
The amount I was claiming for was AED 190,000 which is 3 months salary along with another 3 months that I am entitled to for delay, plus flight ticket... etc.
I won the judgment for AED 100,000 plus 9% interest on this amount (unclear from the date of filing the case - or the date of the judgment given).
In any case, the amount is over AED 160,000 min today. I have also filed for execution and we have now also requested a travel ban - arresting them - freezing all bank assets... etc.
I'm still waiting to get paid. We have informed the old employer and they stall by saying they will speak to their lawyer or they will contact me.
Nothing of the sort will be done as they are just delaying and I don't know what they are playing at.
When will I get the funds and how much longer will this take?

Execution of a labour judgement to ensure payment of dues

Q: My company is based in Abu Dhabi and some of our employees in Dubai were terminated last year (September, October, November 2018).
We employees approached MOHRE and out of 4 times, only 2 times the company PRO attended. And since the company was unwilling to settle the EOSB or even salaries, the matter was transferred to the court.
Since May, salaries were not paid to employees. For the first 2-3 persons, the court had released a judgement and no appeal was done by the company.
And even after the execution stage, the company is unwilling to pay money to those employees. To certain employees, the company started sending lawyers and delayed hearings and appealed twice thus delaying things.
One employee's health condition was not good and he submitted medically unfit documents to the court but nothing happened till date. The company has a branch in Dubai and these employees are under Dubai.
How can the money be collected?

Q: Dear advocates,
I, the plaintiff, won a legal case against my employer. I am the employee.
The judgment date was Feb 7, 2021. I wrote an email to my employer 10 days before attaching the court order asking for payment as per the court order, but there is no response from the employer to date.
Can you advise me regarding further actions to be taken by me to get the money from my employer as per the court order?
Also please advise about the overstay fines if any, as my visa expired well before the judgment date.
As I am jobless for more than 10 months now, I am suffering much, and I want to go back to my home country at the earliest after collecting the money from my employer.
Kindly advise me about the possible remedies.

Q: Hello,
I won the case in April 2022 (AED 18k), I initiated the execution in May 2022, and in June 2022 the court sent letters to the Central Bank, MoHRE, DED, and Dubai Insurance co. to take action against the company.
I am checking the status on the Dubai Court website with my login but there is no reply from any official department on the notices sent by the court.
The company is operating without any problem.
1) What options do I have to get my amount?
2) How much time do the official departments have to impose the bans on the employer?
3) Do I just keep checking for updates on the Dubai Court website with my login?

How to claim your labor dues after getting a judgment in your favor

Q: Hi,
I filed a case against my company for not paying my settlement dues in spite of waiting for 5 months after my termination.
The labor court has decided in its judgment on a claim amount of DHS 20000 as my settlement dues.
The company did not bother to either receive any call from MOHRE and subsequently did not attend the remote hearing in the courts as well.
Now, my question is that if the claim amount is 20,000 Dhs as decided by the court, what is the procedure to notify the company about this judgment?
Will the court notify the company of its judgment or is there any other process to be followed by me to do the same?
Secondly, as I understand, the company cannot appeal the judgment if the claim amount is below 20,000 Dhs.
In such a scenario, if there's no appeal, what's the timeframe within which the company adheres to this ruling by the court to pay off the dues?
And can they explore the option of paying the dues in installments to delay further?

Our internal contract has a notice period of 3 months from both parties. In the new labor implementation, only one month's notice is required for less than 5 years of service.
