Q: Hi. My daughter was arrested from our residence in Dubai on 29 August for drugs. We had just got back from vacation two weeks prior, where she had smoked weed. She has spent a month in jail and yesterday was her hearing. She is sentenced to AED 5000 and deportation. We will appeal on Sunday. Question is, what are the charges for us to get her out on bail? Can the deportation be cancelled? We have been living in Dubai for 30 years and have nowhere to send her.

Q: What are reasons for deportation of a person from the UAE? And is it possible to make a connection flights over the country afterwards? What can be done in order to legally enter the country again?

Q: My brother was caught by CID for marijuana, but he consumed a week ago when they did a urine test which came out positive. I am his sister. I just want to know what punishment he will get, whether it's deportation or a fine. Please guide me as I am alone working here.

Q: Drug takes provocation Hello everyone. I have a short story about what happens with my friend on 1st July 2019. She was invited for a birthday celebration in one club in Barsha with 2 of her friends. Once she went to the washroom with her friend, she met there an English girl. She proposed her to have cocaine and my friend agreed to take it but her friend pushed her to do it too, she said okay, we do it, why not. My friend was already under alcohol effection and you know dear lawyers how it works. They made it in the female washroom. The next day, they opened the door (home) and the police came to her home and arrested her. So, the urine test was positive for cocaine. I have 100% feeling her friend cooperated with CID and she pushes the girls to do it, then she reports it to her friend (CID). As I hear she have an issue (legal) and maybe she makes that to my friend because she makes a deal in that dirty way.

س: السلام عليكم، شخص محكوم بجناية اغتصاب وصدر الحكم عليه بالإدانة بجرم الاغتصاب بالسجن مدة 5 سنوات و تأيَّد الحكم بالنقض. اتفق مع المغتصبة على الزواج وتنازلها عن حقها الشخصي. هل يستفيد من التنازل بعد صدور قرار محكمة النقض؟ وكيف يمكنه فتح ملف الدعوى من جديد لتقديم التنازل؟

أصدر المشرع الإماراتي مرسوم بقانون اتحادي رقم 30 لعام 2021 بشأن مكافحة المواد المخدرة والمؤثرات العقلية، وقد نص في أحكامه على عقوبات الاتجار، الترويج، أو النقل للمواد المخدرة، كما أفرد أحكامًا خاصة بعقوبة تعاطي المخدرات في الإمارات. نقدم هنا لمحة عن أحكام المادة 96 من القانون والمتعلقة بحالة ضبط أطعمة ومشروبات أو منتجات يدخل في تركيبها مواد مخدرة.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.

The provisions of this Federal Decree-Law No. (31) of 2021 Promulgating the Crimes and Penalties Law, known as the "New UAE Penal Code", governs criminal actions in the United Arab Emirates. The New Penal Code repeals the previous UAE Penal Code (Federal Law No. (3) of 1987 Promulgating the Penal Code).
