Q: Dear sir,
I am working in an LLC company based in the mainland of Dubai with a limited-term contract. I have completed 1 year of my service with this company.
My company is dealing with fire and safety system maintenance. I have received the offer from the company for the position of an electrical technician for fire and safety systems.
As per my MOL contract and visa, my profession is an electrical technician, but, unfortunately, my company doesn't have any jobs related to the electrical system. I have been doing some other jobs like cleaning of fire extinguisher and loading/unloading jobs for the last year.
Now I would like to resign from this company due to some physical illnesses, but my company is asking for visa costs to cancel my visa.
What is the compensation I have to pay to the company?
How can I resign legally without a ban from this company?

Q: Dear Mam,
I am currently working in Ras Al Khaima as a limited contract staff. Currently, I am in probation period and have finished my 4th month of probation.
In the present condition, the job role is different from what the employer told me at the time of joining. I would like to know, am I able to resign after my probation period? And should I pay anything for my company?
And will be there any problem for submitting resign before the completion of my contract?

Significance of the job title and designation on labour contract

Q: I had signed an unlimited contract with a Dubai based company.
In the offer letter, I was given a designation as Business Manager with salary AED 30,000/month. However, in the MOHRE contract, my designation is showing Sales Executive having 4th/5th level skill.
When I inquired from them, they told me that the designation in MOHRE contract will not have any adverse effect during my stay in Dubai and they have mentioned 4th/5th level skill in the contract because my certificates ( B Tech ) are not HRD attested ( in India ) and they will not be able to wait for long for this attestation.
My questions are:-
a) Is this procedure legal i.e. getting a person of Engineering degree in 4th/5th level skill set?
b) Will it be possible to change the skill level in MOHRE contract if I get my degree attested by HRD and UAE consulate after I land in Dubai?
c) What are the possible issues that I will face?

How can we have the outsourced visas of our employees transferred to our company?

We are Dubai LLC company where we have outsourced the visas for our employees to an outsourcing company. But now we want to bring all our employees (around 200) under our visa.
Can we transfer and continue the gratuity of all the employees under our visa legally through an undertaking from the employees while they continue to work with us?

Traveling to home country after joining a new company with a visa in process

Q: Dear Sir/Madam,
I have an offer from another company in Dubai. I currently work for a Free Zone Company in Dubai, and I joined last year on a 2-year visa. I will be moving with 1 year still left on my visa.
I have already informed my new company that I want to travel to my home country after 2 weeks of joining, and they have allowed me to do so.
However, I am worried that if my current employer does not cancel my visa on time and my new company is not able to process my visa in the meantime, I will not be able to come back to the UAE.
Can I show that my visa is in process at immigration, or should I go on without worrying, as both employers should deal with it?

My son has been selected for pilot training interviews at Emirates Flight Training Academy.
Is it possible for him to travel to Dubai as an unskilled laborer, attend the interview while there, and then quit the job and start the training program if he is selected without any problems with the employer?

Our internal contract has a notice period of 3 months from both parties. In the new labor implementation, only one month's notice is required for less than 5 years of service.
Please advise if we can follow our internal contract since the position is very curtailed and the organization will not be able to replace the position within one month.

Annual leave salary calculation as per the new labor law.
Can you please clarify the correct annual leave salary rules?
Some say it is basic + HRA for the month you will take off, others say it is full salary, and somewhere I read it is basic + HRA (annual leave salary) plus the normal salary you get.

How to appeal the labor judgment if the court did not approve all my dues? 0
My employer has not paid my salary for 8.5 months. I went to the labor court, and was referred to Dubai Courts.
The judgment came and I did not receive the full claim including salaries and 3 months' compensation.
