Q: Hi,
My employer has not paid my salary for the last 4 months. He has asked me to leave the country and stay at home till he pays the dues.
I want to leave Dubai with proper cancellation of my work visa and labour contract after receiving my unpaid salary and EOSB at the earliest possible.
I don’t want to file a court case since I have received another job offer.
Is it possible to file a labour complaint to cancel the visa and labour contract and get unpaid wages then leave Dubai?
Is there any possibility of a travel ban?

Q: I am working in DMCC. My company is not paying my correct end of service nor unclaimed leave salary nor notice period.
Also, they deducted 2000 per month for 7 months saying it's cost-cutting which I never accepted, and they said they will compensate later.
Which court do I need to approach if mediation there fails and what are my rights? Is the mediation not able to tell that too there?

How can I get my labor rights if I have to leave to my home country?

Q: My salary has been deducted by the management. I understand that I can complain to MoHRE and go to court but I know the process could take 6-18 months in court.
My queries:
1) My visa and contract are expiring. Can I go back to India and continue the litigation?
2) For the bank accounts, if I have to close them, then how does the court ensure I get the payment?
If I have to stay here and fight without a salary, I will incur huge expenses and stay in the country without a salary.
I do not intend to stay in the country, so can I still file a case and come back on the dates of the hearing?

How to claim the pending salaries after leaving to home country?

Q: Hi Everyone,
I was having pending salaries for about 5 months with my company. I sent them many emails for releasing my salaries as I was having room rent, food, and transportation plus supporting my family in Pakistan.
No one replies to my emails from HR or any other department. Then I sent a leave application with an official email that I have no money and I am going to my home country. For that email also no one replied.
I left the country and stayed in Pakistan for 40 days. Then I sent them emails for my pending salaries and ticket to come back for work.
My company's HR replied to me that I went without management approval and they decided to terminate me. Before a few days, they gave me a termination letter with immediate effect.
Kindly advise what should I do and can I get a one-month salary for termination without a notice period?

Can I travel back home if there is a pending complaint against me in MOHRE?

Q: Dear Sir/Madam,
I resigned from my company last month before completing my probation period.
I complained to MOHRE about my employer holding my passport, and then my employer filed a complaint against me in MOHRE for compensation of 5,000 AED for training.
Can I go back to my home country if the complaint is still pending?
Will there be any problem with immigration at the airport?
(The complaint hasn't reached the court yet).

Labor case filed, cancellation in progress: Can I travel outside the UAE?

Q: Dear Sir/Madam,
My company filed a labor case against me two months ago. I went to court, obtained a non-registered application, and applied for cancellation in Tahseel.
It is currently under processing.
My question is, can I travel outside the UAE now?

Q: Dear Sir/Madam,
I resigned from my company during my probation period. However, they rejected my resignation, asked for compensation for visa fees, and did not release my salary.
That’s why I filed a complaint to MOHRE. However, they also filed a complaint against me claiming 6000 AED. My complaint to MOHRE is still under process and I am still waiting for an update from them.
I need to return home to my country; however, what's confusing me is whether I am allowed to leave and go back without any issues at the immigration.
The complaint is still under processing and it has not been referred or transferred to court yet.

Can I cancel my house sale contract without extra fees after personal plans changed? 0
Dear Lawyers,
I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August.
Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F.
The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer's real estate commission and the conveyancing fee.
Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this?
Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Can the landlord evict me from apartment for personal use if he lives in his own property? 0
The owner sent me a notice by email saying that he doesn't want to renew the contract for the purpose of personal use.
He didn't mention what this personal use means. He already has multiple houses for rent and he has his own which he is living in currently.
