هل يمكن إنهاء اتفاقية شراء عقار واسترداد وديعة التأمين لأنه مرهون؟

مرحبًا،

لقد دفعت وديعة تأمين لشراء عقار من مطور عقاري، حسب خطتهم المالية الخاصة. لقد وقّعت على استمارة حجز بعد دفع الوديعة.

ومع ذلك، اكتشفت أن هذا العقار مرهون أثناء إجراءات العناية الواجبة، على الرغم من أنهم قدموا لي سند ملكية ينص بوضوح على أن العقار "غير مرهون".

هل يمكنني التراجع عن هذه المعاملة واسترداد وديعة التأمين؟

Dear Questioner,

The property should be free of mortgage as the mortgage means that there are rights in favor of a bank.

And if they mistakenly sold it to you, the amount should be refunded.
