Labor appeal
Q: My employer has filed an appeal to the Dubai Court decision on our labor case where they did not show up by submitting a backdated termination letter showing termination before the filing of the labor case. I have the pic of actual termination letter which I was asked to sign after the labor case.  Actual timeline 21-07-2015 labor case filed, 27-07-2015 I was asked to sign termination which I didn't backdate, the document shows 18-07-2015 before the labor complaint.

Will the appeal court listen to the employer's fake allegations and judge in his favor?
Q: Hi, I have won a case of dirhams 8400 but my company has filed an appeal case and has put fake allegations on me of 20 thousand dirhams. When I went to submit the memorandum reply, 3 people have advised me that since the claim value of the case is less there is no need for any reply to the memorandum. My hearing for final judgment is now decided for next month. I'm still scared if I will not receive my payment and if I have to end up paying 20K to my employer. Please suggest. Also please advise what happens if I lose this appeal case.

Submitting a new memo with a new claim in a labor case
Q: Hi, I already have a labor case number. My first hearing is already set for the 1st week of December but I want to change the memo submitted since the amount mentioned there is not the amount I want to claim. The 1st memo submitted is done by a typing center. Can I upload the new memo through any typing center? And when can I upload it?

Appealing a labor case with the value of 205,000 AED
Q: Dear sir/madam, Can we appeal in the court of cassation for a labor case with the value 205,000/- AED? It is a labor case initially with the labor court, then we approached the appeal court. The claim amount is 205,000/- however, we feel facts in documents have not been considered. Can we approach the court of cassation for appeal under the full jurisdiction labor case category?

Can the employer file counter criminal or civil cases against a labor case by the employee?
Q: Hi, My query is that my husband and his 3 colleagues won a criminal case that was filed against them by their employer accusing them of theft and cheating. The employer has not paid full salary and gratuity and has harassed them a lot for 18 months. My husband and his colleagues want to claim everything by filing a case in labor court. Are there any chances that the employer can file any other case in civil court against them? The Dubai court has already dropped all the criminal charges that were put by him on my husband. Can they move forward with filing the other case in labor court? Is there any risk from the employer?

How to appeal the labor judgment if the court did not approve all my dues?
Q: My employer has not paid my salary for 8.5 months. I went to the labor court, and was referred to Dubai Courts. The judgment came and I did not receive the full claim including salaries and 3 months' compensation. Please advise whether I can go for an appeal and what will be the time for execution. Need your valuable advice.

I won the case against my ex-employer based on a lower salary. Should I appeal?
Q: Dear all, I have just won my case against my former employer. However, the salary the court used for the calculations of my arrears is the one mentioned in the labor contract (46000 per month) instead of the actual salary paid out via WPS (55200). I hired one of the best law firms here, and we submitted salary slips, bank statements with credits, and a salary certificate with 55200 as the salary. However, the judge used 46000 to calculate the payout. Now, I have the option to appeal. But the difference is barely 20000 and from what I have heard, the appeal could take 2-3 months more. What should I do? Appeal or take whatever is given? Grateful for your thoughts on this matter. Thank you.

Can I cancel my house sale contract without extra fees after personal plans changed?
Dear Lawyers, I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August. Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F. The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer's real estate commission and the conveyancing fee. Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this? Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Can the landlord evict me from apartment for personal use if he lives in his own property?
The owner sent me a notice by email saying that he doesn't want to renew the contract for the purpose of personal use. He didn't mention what this personal use means. He already has multiple houses for rent and he has his own which he is living in currently. Is it legal to evict me? Thanks
