كيف يمكن تنفيذ حكم في قضية عمالية إذا كانت الشركة غير نشطة؟
لقد حصلت على حكمًا لصالحي في قضية ضد صاحب العمل السابق (شركة ذات مسؤولية محدودة). الآن الحكم في مرحلة التنفيذ.
فرع الشركة الذي كنت أعمل به أصبح الآن غير نشط. لا توجد أصول أو أموال. لقد عينوا أحد الأشخاص مديرًا ونقلوه إلى الهند، لذلك فإن اعتقال المدير غير ممكن أيضًا.
صاحب الشركة لديه شركات نشطة أخرى. إنهم غير مستعدين لدفع أي شيء على الإطلاق. معظم زملائي ينتظرون أيضًا في مرحلة التنفيذ.
لقد مضى أكثر من ثلاث سنوات حتى الآن. هل يوجد حل لاسترداد المبلغ المستحق من صاحب الشركة؟

Please note that the execution applications can be submitted only against the company in which you were employed.
If your employer has started a new business with a new license, the court cannot take any action against the new company even if the shareholders are the same.
I assume the company is an LLC and in that case, the shareholders will have lability only to a limit of the shareholding.
