Q: My salary labour case has been going on for 7 months now. After the 1st judgement, the owner appealed because of which I had to wait again and go for the 2nd judgement. Q: Hi, I have won a labor partial case of DHS 8400 and after the final judgment, my employer has registered a labor appeal case against me and has put an allegation of 20K on me instead. On the first hearing, the judge told me to reply to the memorandum that the company submitted and when I visited Al Adheed center, they advised me not to reply to the memorandum as it is not needed because ultimately their appeal will be canceled as the claim value of the case is less. My hearing for final judgment is now decided for next month. I'm still scared that I may not receive my payment and instead, I may I end up paying 20K to my employer. Also, please advise what happens after I lose this appeal case. Please advise!

Q: I have an employee who filed a labor case that is in execution. I have tried over the last 2 months to reach an amicable settlement with him on the payment of his settlement. My commitment to him has been based on the commitments I have received from my clients to the company. He initially requested a 25% down payment and 6 PDC checks which I agreed to and he has since rejected that and then demanded 100% of his settlement which he then modified to 50% and 3 PDC checks. I informed him that it would not be possible to pay 50% and 3 PDC checks; the best I could do is 40% and 3 PDC checks as I needed the remaining funds to cover the current employee's medical insurance, some of them have critical medical conditions requiring monthly medication. He has again rejected that and is demanding a 50% down payment to release the case and the block on the company trade license and bank account. I also have other PDC checks due and with a blocked account, these checks will bounce. The settlement is 291KAED.

Q: I am an employer and have lost a case by an employee (the claim is AED277000). One aspect of the payment is for around 130000 which we dispute. What is the cost to appeal and is it worth appealing given the costs? Do we need an Emirati lawyer?

Q: An employee, after receiving his dues from the labor court, is again making false allegations that he didn't sign a contract for salary reduction and has now approached the police and filed a criminal case against the Employer. During the labor court investigation, the documents were sent to a crime lab for checking forgery, but the employee didn't go to the investigation officer and he was fined by the labor court for malicious allegations. The labor case is closed and the employee labor card is canceled by the labor ministry. He now went and made a false complaint at the police station on the same topic that he didn't sign contract papers. Please advise, as an honest employer, How can I protect myself from these false allegations by the staff?

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

The law promulgates UAE Civil Procedures Code (Civil Procedure Law) which governs civil procedures in the United Arab Emirates, including the prosecution before the courts, litigation and execution.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
