Q: Dear Sir,
One of my friends did cash embezzlement in a company and he returned the full amount also but now the company filed a Tawafuq complaint.
What will be the scenarios of the penalty?
The passport is with the company and he got terminated. Their Tawafuq hearing is on Saturday.
Please advise.

Q: Hi Sir,
I have a case in Dubai Courts for the embezzlement of 30500. When I appeared in front of the judge in the 1st hearing, they asked me if I did it or not.
I said I did not, then they said I need to submit my reply in Arabic to defend myself.
What will be the charges from the court if I lose the case and where can I get it translated to Arabic?

Terminating an employee for poor performance and misappropriation of funds

Q: The company's accountant has not been performing his duties professionally and has received several warning letters. He was also not producing any kind of reports despite requests and warnings. His salary was cut several times due to this.
Finally, upon being forced to produce at least some report we found many issues including approving expenses without Management approval, cash missing which he was responsible for, not recording transactions properly... etc.
We want to dismiss him as he made serious problems for the company and we don't want to pay any benefits except for the last salary.
We have filed a complaint to MOHRE based on Article 120 asking for termination and damages, but he also filed a complaint asking for full benefits.
What is the safe procedure for us to close this matter?

Q: My partner and I are now residents of the UK but while we were in the UAE, there was a company-to-company deal signed with a client.
In between the completion of the contract, our company was transferred to someone else in the UAE. This person continued to honor the contract with the client.
But now the client is pursuing a personal legal case of misrepresentation in the UK against us, saying we misrepresented facts to their employee and got them to sign the contract.
We are mentally & monetarily being harassed by the client. My questions are:
What kind of counteraction in the UAE could we take against them for threatening us with legal proceedings and harassing us without any legal reasons and despite the contract not having any clauses against which we did the deal?
Also, is there mental harassment recognized in the UAE courts?

I made half payment for an embezzlement amount and the company has given me one-month time.
Can they retract the agreement?
Will that be valid? And can the company file a complaint against me?

Asking for returning the gifts and threating to file a case

Q: Dear sir/madam,
Ex-personal training client bought me gifts. Now, he has sent an email from their lawyers asking for 1.4 million AED back within 5 days.
I started training a very wealthy client last year. I’m female, he is a male. He started to buy me costly gifts, flight tickets, and even a car.
This was a strictly professional relationship although I did know he seemed to have feelings for me.
I told him I had gotten into a relationship, he then said he wanted me to leave him alone.
A few weeks later, I got an email from his lawyers saying all the money he spent on these gifts, including all money for training, he wanted back; 1.4 million AED worth. As I have “breached” the contract.
We never signed any contract. I never asked for any of the gifts. I never agreed to anything he bought me being a payment for future sessions.
Has he got any right to do this? Can he take me to court? I do not have the money to pay him back.

What to do if my employer claims back an amount I took then returned?

I have been working in a company for more than 1.5 years in sales and there were two transactions from the client that I took into my friend's account, as we usually do sometimes to make a commission from the customer.
But I returned the whole amount to the company which was 64k and I have a receipt of 40k but I paid 24k in cash. Then after 2 months, I resigned from the company for some personal reasons.
I was the performer of the company and they won't let me go then they started investigating me when they knew about these transactions, but they used it against me in the police and court as well.
They did not have any proof or evidence to prove that they hadn't received it, so they took an oath of AED 24k. Now, the court has passed the judgment for 24k and I need to pay now.
There is yet a police case that is in prosecution but I am scared of what can be judgement in that scenario as per your experience.

Q: I am convicted in Ajman. Now I have appealed. Last time, my lawyer did not talk in court at all.
Most lawyers don't know anything about cases so they cannot talk.
This case is fake against me. Can I talk in court about the facts and evidence of the case myself?
Can my lawyer tell the court that I want to talk about this case other than the defense paper?
Will the judge accept and listen to me verbally also?

I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August.
Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F.
The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer's real estate commission and the conveyancing fee.
Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this?
Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Tenant always late with payments, hasn't renewed contract. What to do? 2
Hello,
I have a tenant who is always late with their payment. Their renewal was supposed to be last December 2023.
Currently, they have not signed any new contract, provided any new cheques, and have stayed for three months from December until now without paying rent.
Additionally, I just discovered that they have sublet the apartment with partitions, which is clearly stated as not allowed in the old contract.
Please let me know what should I do legally!

Tenant received renewal notice, rejected proposed rent on renewal day. What next? 2
Hi,
We sent a renewal notice to our Dubai-based tenant 84 days before his contract renewal, with a 10% increase in rent.
The tenant neither agreed nor disagreed with the proposed rent and replied on the day of renewal that he wouldn't be paying the proposed rent.
Due to the argument, the landlord decided to reduce the rent, but the tenant has not yet renewed his contract. It has been 12 days since his contract expired.
Kindly suggest what could be done in this matter.
